anyone know there way around benefits dwp dont seem to

    She would have been IB credits only. This means she had not paid enough stamp for IB to pay the benefit, so I.S paid the benefit.
    When you moved in with her I;S claim closed as you worked full time. But her IB remained open with them given her credits only IE they pay her stamp, towards her pension but she is not entitled to any IB paid benefit.

    If she had then it would have kept on being paid as you moving in and working full time would not effect it

    Long term IB must be IN PAYMENT not credits only
    for a partner on a JSA or I.S claim to give the D P.

    but for the customer on a I.S claim
    Long terms IB credits gives the DP
    but long term IB credits for a partner on a I.S claim does not

    complicated I know but I am a hundred per cent sure
    you are not owed any arrears whilst on JSA iro of her IB credits claim :(

    After JAN 2012 having a live IB Credits claim was not AND is still not Condition of entitlement to I.S at the new claim stage......
    as your partner closed her claim when you moved in the she couldnt reclaim when you lost your job hence you went on JSA
    as you had no entitlement as a couple then to Income Support
  • i really dont understand how this works! when i moved in and her income support stopped why didnt the IB start paying her again? i was working 16hrs and just reached the amount for WTC.
  • also her stamp did not need to be paid by IB as it was done by CB, she received he income support as it was the highest award
  • i understand but she had been claiming CB since she was 17 so why would IB just take over that

    IB didnt pay because she had not paid enough contributions in the relevant tax years, that is why I.S paid instead as she could not be left with no money,
    When you moved in her I.S closed IB could still not pay any money as she was not entitled but they could give her a credit as long as her claim to IB remained open


    As to child benefit and IB both giving her credits then if two are awarded for the same period only one will count towards the pension.

    I think OP you think you should have got DP on JSA because of her IB credits unfortunately you don't.
    A welfare rights officer will confirm all of this when or if you made an appointment and went to see one

    it appears everyone giving me information on this is wrong.......been talking to dwp and they have told me that when i first started the jsa claim i could of also claimed IS at couples rate and we would of had the premiums added. although my wife was only having her stamped paid it is still a active claim and she still excused from work because of ill health.

    it seems there has been negligence at some point in our claim i am now in the process of finding out what can be done.

    Did you speak to someone at the point of start of your JSA claim about what you should or shouldn't be claiming ?

    yes i did i asked about IS and JSA i was told i could only claim JSA.

    also asked a handful of times during my claim

    you stated that your wife closed her I.S claim when you moved in because you were working. you then gave up work to look after her and claimed JSA.
    what year and month was this ?
