So, on your seventh post to the thread, you actually tell us what happened. Not drip feeding us at all, definitely not ;)

Ive admitted it could have been a bit clearer. Obviously it wasnt.

Im not drip feeding you info at all. I signed up with nielsen marketing and they sent me a scanner. This did not work properly i had a replacement which also didnt work. At this point i contacted them and arranged for both scanners to be returned and my membership cancelled. The courier picked them up and gave a receipt. I heard nothing then for about six months. A couple of days ago i had a letter saying they had contacted me several time asking for the scanner back. They have not contacted me before this. They said if tge scanner was not returned within seven days tgey would start proceedings to get the money for the scanner. Now, why would i want to keep a scanner which can only be used for their company? I wanted to know if they can ask for money for the scanner and enfirce this legally as they had not been in touch before now? Surely if the scanner was missing they would have written sooner?
Of course they cannot expect you to pay for the scanners if they have already been returned.

You still haven't said, but can we assume that Nielsen paid for and arranged the collection directly with the courier?

Reply to Nielsen's letter stating that the scanners were returned on xxx date and collected by ABC couriers.

Enclose a copy, not the original, of the courier's receipt with your letter.

If Nielsen arranged and paid for the courier, then Nielsen need to look to the courier for the missing scanners.

What about if i cant find the receipt? It is six months ago so i may not still have it. And yes nielsen arranged for the courier.

Then you have no proof that the scanners have been returned, have you?

    Start looking for the receipt.

I would still write that letter, but leave out any mention of the receipt if you really cannot find it.

Point out in the letter that they arranged the courier, so they should be asking the courier where the missing scanners are.

Many thanks for your input. I will look for the receipt but tbh i think they should be asking the courier anyway after this length of time.

Your issue there would be that without the receipt, the courier could simply say that they didn't collect anything from you.

Your only way to dispute that is to show them the receipt, therefore proving that the scanners ceased to be with you.

Your asking if they can chase you for a product sent back to them, Well yes they can, just because they organised the courier doesn't mean you gave it to said courier. Of course you did, you know you did but can you prove it?

Now if they want to chase you for the cost of said product then they need to do this through the small claims court, which a reasonable person will decide on both the evedince they have before them and the balance of probabilities.

If you can at least remember the courier co that collected it then you may have a good case due to the passage of time being unreasonable for you to hold on to the receipt and the nature of the product being of no use to you so no reason to keep it.

I suspect however that if you tell them to take you to court and not to bother you again until the case is heard, you will not hear from them again.

Thats the problem really. But who seriously keeps receipts going back six months? Not many i would think.

Good idea. If i cant find the receipt i will remember that. Someone on the nielsen thread on another board said that nielsen told them ths letters were sent out mistakenly so you never know i might be worrying over nothing if that is the case.

Then why not ring Nielsen, is there a number on the letter?

Tell them how shocked you are to receive it, how certain you are that their scanners were returned.

    See what they say.
