Nielsen demanding scanner sent back months ago

    There's confusion because you didn't specify in your OP and I've never heard of that scheme (and apparently neither have some others).



    Did they send a courier to your house, or did you arrange and pay for the courier? If they sent it then as you say they should contact the courier, but if you arranged it then it's your problem as you're the one the courier has a contract with.

    Either way, that brings me back to the receipt you mentioned. Was this for the courier?



    If you owe them money then the statute of limitations is 6 years, so yes they can chase you for it after 6 months. I still don't know for sure whether you owe them anything though.

    I dont owe them anything. The scanner was sent back, i had a receipt for the courier. They failed to contact me afterwards. I think i have my answer from the other thread. I will ignore the letter as it looks like a mistake. Thanks to all who replied

    Well if they arranged for the courier and you can prove the courier was given the scanner then as you say you've done your bit. If you arranged for the courier yourself then your duty of care for the item doesn't end until the courier delivers it. If the courier lost it then you still owe Nielsen a scanner, and the courier will owe you something for breaching the contract.

    The problem here is that the OP is drip feeding us crucial information, and reluctantly at that.

    So in all likelihood any time spent analysing what info we have so far will be wasted when some extra, fundamental piece of information gets dragged out.

    Im not drip feeding you info at all. I signed up with nielsen marketing and they sent me a scanner. This did not work properly i had a replacement which also didnt work. At this point i contacted them and arranged for both scanners to be returned and my membership cancelled. The courier picked them up and gave a receipt. I heard nothing then for about six months. A couple of days ago i had a letter saying they had contacted me several time asking for the scanner back. They have not contacted me before this. They said if tge scanner was not returned within seven days tgey would start proceedings to get the money for the scanner. Now, why would i want to keep a scanner which can only be used for their company? I wanted to know if they can ask for money for the scanner and enfirce this legally as they had not been in touch before now? Surely if the scanner was missing they would have written sooner?

    Okay, maybe. So now does everyone understand my situation and can anyone offer anything more than what has as already been said? As i undersrand the contract is between the courier and nielsen so they need to contact them is that right?
