its my belief that you should have had a notice to keeper in decemeber, then had 28 days to appeal , they then sent you the notice you posted in january meaning you were past the appeal deadline so they were holding the RK responsible
earlier in the thread you said you had emailed the appeal, now you say you posted it, but time was of the essence when you actually appealed so it should have gone in online, but may have been out of time anyway
just strange how they went straight to an LBCC so quickly, maybe its a new trend ?0 -

I hate to say this but they have got the better of me, there is a lot of imformation to take in. I have 14 days to pay before they proceed with court action. This is starting to make me feel ill just worrying about the situation. Im going to speak with a manager from one of the shops tomorrow to ask for their help too. With this I will decide what to do....
I hate to give in but this is too much for me to deal with.
Please keep the faith, I suspect complaints will stop this.
1. Complain assertively and bitterly to the Managers at the retailers. Take all paperwork, show them the rubbish you are being bombarded with! Also take receipts or bank statements as proof of purchase even if from other days (to show yourself or family as regular customers).
2. Send an email complaint to the BPA and DVLA saying you got no reply to your posted appeal which was within 28 days of the PCN letter which you know arrived 'over Christmas' but has been discarded now as you had appealed and thought it was over. The email addies you need for the DVLA and BPA are in the sticky thread for NEWBIES, that's what all the advice is there for.
3. Send the letter you have found by zzzLazyDaisy (the one you quoted above) but also add in copies of your receipts (keep originals) and add a paragraph to mention the driver and passenger were legitimate shoppers and you are disgusted at this treatment and have complained to the Store Managers on site. This was a particularly busy Christmas shopping day and cars were queuing in and out so obviously longer was needed than normal.There have been 'over' (!!) letters but my mum has thrown these away.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

thanks, just seems to prove my theories were correct, they have ignored debt collection and gone straight to LBCCC after you appeared to fail to appeal in their eyes (this being a new tactic it would seem, with you as the guinea-pig)
so you need to read what CM said in post #34 and do everything she told you to do, all of it, no missing anything out as I believe she gave you the best advice here based on my scenario. just seemed strange it went to LBCCC so quickly, still does too , but you have to deal with it in the manner she stated
had you appealed it in december 2013 and provided proof of patronage of the retail shops etc on that site, PE would likely have dropped it , so now you need a robust LBCCC rebuttal , this point 3 by CM now becomes that appeal that you should have sent before xmas , but do it in exactly the manner she tells you to
so they were the following 3 points

bear in mind that at this point you are trying to get a cancellation or a popla code to come back from PE (but you may get something else instead)
you are also trying to get the BPA and DVLA to investigate and again are angling for cancellation or a popla code
and you are trying to get the shops or landowner or managing agents to cancel the parking charge too
so ideally , cancellation, or a popla code , not court if it can be avoided
CM has managed to get another one turned to a popla code from imminent court proceedings by backing them into a corner had they proceeded to court and refused popla adjudication0 -

I spoke to a store manager about my situation, she phoned PK and cancelled charge. Should I expect to hear from PK ? Or dare I say it, is this situation all over with?0 -
its never over until you get something in writing saying its over
so if you get a popla code or anything else, deal with it as if its "live" , even if it isnt0 -

That is a very short and terribly badly worded 'LBCCC' bearing in mind PE have had enough pointers from zzzLazyDaisy's suggested responses! Can that 'LBCCC' picture be linked in the LBCCC Fightback thread in a new reply, could be useful to check in cases where people have lost their version but the timing was around now.PRIVATE 'PCN'?
