It just goes to show the only really strong argument is losses to the landowner.
I have to say I still remain a bit bewildered by it all and all the advice and really complicated appeals,
A friend emailed me to say send this letter to them, it worked for her and she got advice in Aug 2013 from MSE. Admittedly it was Tesco's own car parking firm appeals but she didn't go direct to the store in person.
Dear Sir/Madam
I have returned from my vacation to find your invoice in respect of a charge notice Ref ******** for Vehicle ******
Any debt of liability to your company is denied as the charge you seek is punitive penalty and in no way represents the actual losses incurred by the landowner
Either cancel this charge forthwith or provide a POPLA code so that I may refer the matter to POPLA
Yours faithfullyThe most wasted day is one in which we have not laughed.0 -

The absolute best I'd predict from that level of appeal to the PPC is a POPLA code. The likelihood would be a response stating that it wasn't an appeal and they need more information on which to make an appeal decision.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Well hers was dropped but as I said it was to Tesco's own appeals.
Why are CPS getting successful court judgements? I've just been reading a few through and a lot of the arguments people put up on here seem to being thrown out by some District Judges.The most wasted day is one in which we have not laughed.0 -

Because county court small claims can be a bit of a lottery and PPCs are paying csolicitors £300 to represent them at court. Luckily most of this £300 is not awarded against you in costs if you lose.0 -
Can you take this discussion off here, this is nothing to do with popla decisions - thanksWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Hope im not out of order posting here but if no GPEOL is so good a fight tool against them why do the PPCs still go through with paying for POPLA when in your first complain the the PPC you say you are argueing no GPEOL. Do any PPC drop it because of GPEOL at 1st complain.0
