Parking Notice Issued 16/01/2014

Hi,

Today I received a parking notice stuck to my windshield from 'UK Parking Patrol Office' asking for 60£, or £100 if not paid within 14 days. I was parked in Manchester Aquatics Car Park on Oxford Road in Manchester and paid for 2 hours. Unfortunately, the class I was in at uni ran for 20 minutes longer than expected so I could not make it back in time.

Obviously, I'm not going to fork out that ridiculous sum of money for a meager violation in which was in essence a victim-less crime.

Could anyone advice on my next course of action, should I ignore the letters and following letters. Or cave and pay the fine?

    Cave and pay - NO

    It's NOT a fine.

    Once you've read the sticky post further questions here but I expect you'll have the answers you need.

    it cannot be a fine as no court or judge has imposed it

    therefore its a parking charge notice (an invoice)

    In my case would this be a fake 'PCN' as it was attached to my car by a private company ? Sorry I'm new to this.

    A 'real' PCN is a PENALTY Charge Notice

    Private parking companies issue Parking Charge Notices and call them PCN's to try and make people like you and me believe that they are in fact the same as 'real' ones, hence the term you will see on this site and others is 'fake' PCN.

    As Redx says, read the sticky, it will answer the questions you have. However for clarity;

    do nothing in terms of appealing until you have the Notice to Keeper (assuming you are the registered keeper of the vehicle)

    do complain to the business/retailer/swimming pool (i'm unfamiliar with Manchester Aquatics) but if you do so in writing keep it in the third person - so 'the driver on the day' etc

    OK, so for absolute clarification purposes I should follow these steps:

    1. Consult land owner in writing, complain politely about the ticket, how it was placed on unfair grounds and how I cannot afford to pay.

    2. If 1. doesn't work, wait for 'Notice to Keeper' to arrive by post.

    3. Then follow appropriate posts relating to appealing and 'POPLA' decisions.

    And on what grounds would I be able to complain to the landowner on ? For instance I overstayed the 2 hours paid time by 20 minutes. Can't find anything to do with this in Newbie threads.


    Any responses would be amazing as I'm screwing here a little with so many options on the table !

    I guess that depends on the nature of the car park arrangement - is Manchester Aquatics part of the university or do they allow university parking onsite or is it a separate entity altogether? If the latter then you might not have any grounds to complain at all to the landowner, in which case simply wait for the NtK.

    If one of the former you could simply say that due to circumstances beyond your control you were delayed 20 mins, you are happy to pay the £1, £2 etc that might be reasonable for parking under any normal circumstances but would appreciate them contacting the PPC and having it cancelled.

    that is because only you could answer that

    frankly, I havent seen one in your posts, but lets assume you had bought a £100 fish tank and £40 worth of tropical fish etc, that would be a good reason

    but I assume this is the place near the APOLLO at ardwick green ?

    so a place that gets regular visitors from people not using the shops in the area , but parking to go to the nearby university and museum and hospital and that theatre instead ?

    well if I was a landowner there I would be annoyed too ( playing devils advocate here ;) )

    if you did have a good reason to complain to that landowner, like the ones I mentioned, then fine , no problem , do it

    but you cannot use the fact that you went "off site" and were delayed as that hardly constitutes a defence , on the grounds that you should have paid extra for the overstay but dont appear to have done so

    in any case, wait for the NTK and then appeal in the same manner as everyone else , ie:- to the ppc, then popla
