    Someone being at school doesnt necessarily make them a minor, people can be at school at 17 or 18 years of age.

    She doesnt need a lodger. Her ex has not left and he is jointly and separately liable for the mortgage. I would encourage all males and females engaging in sexual activity especially with a new partner,to get an MoT.

    He may be liable, but that won't help if he can't pay.

    The locks are a red herring. You've not suggested any need to be thinking about them, especially in light of your comments above, so don't worry about them.

    You really need legal advice. That would clarify your concerns in your last paragraph as well as letting you know about other aspects.

  • I am not familiar with Scottish law but aside from some specific areas, i doubt it differs that much from English law with regard to base principles. I would submit that the civilian CAB advisor has misinformed you.

    The confusion here is between emotional issues and the LAW of the land.

    The LAW of the land would appear to suggest that your ex partner has a legal right of occupation as do you.

    If you make verbal and physical threats then you may be deemed to be engaging in criminal activity which if detected by an officer of the law, my result in you being at least warned and if there is sufficient evidence,,arrested and possibly charged.

    Now then, there is no need for such a fracas. Just simply agree that the relationship is over and try to get along until the formalities are settled. Did you say you have a child together? Very well,think of the child.

    The "Amen Corner" of embittered women may well say throw him out and change the lock. That is an emotional response and one which doesnt not stand up to examination in law.

    I didn't threaten him in any way. He asked if he could come back for a suit for court today and I said of course he can but his stuff was all in the garage. He came and got it and never spoke. He text me later asking for a charger and I said sorry I must've forgot it and he could have that too. He didn't come get it.
    Im all for being fair, Im over it, I can't be doing with anymore stress, I just want it sorted and to move on.

    On a side note, just heard from him - he didn't get banned. Makes it easier for him to see his new g/f which is very hard for me to think of

    Indeed,we await further from the OP though if the person was of legal age then it would appear that there were no offences.

    I see,so he left voluntarily then. Thats his choice. He may well choose to return. Would you contest that though he appears to have a right to reside? On a plus not, plent more fish and should you choose,im sure there is another Mr right for you and at some time in th future you will look back and smile..

    I dont think this is relevant to the thread. At all. If an offence had been committed you would think that the person who was aware of it would have the sense to do something about it.

    Im sorry but this thread is now growing arms and legs, she posted on here about legal advice re her home, its not about her partners cheating, Im aware she mentioned it but what does this have to do with the thread subject? In particular legal advice about whether the locks can be changed or what hes responsible for paying?

    Did he actually say, "I didn't get banned, it's great as I can see my new GF"????? Jeez

    And sure the student may be of legal age and it's all above board, but that doesn't make it any less scumbaggy. He may only be in his 30s, but it's creeping into dirty older man territory.
