to be without a TV for 4 months is the irritating fact and if we could claim something back from them for the inconvenience it would be a bonus. I'm not after trying so sneak something or claim something illegally, but perhaps an additional 4mths warranty for the length of the delay, or some kind of goodwill gesture would suffice.
They've offered you a bigger TV. You've already experienced how 'useful' the warranty is - you should treat these supermarket brands as unrepairable, take the bigger TV, enjoy it while it lasts, and replace it when it breaks. Warranty period isn't a very good indicator of how long a product will last, you could get years out of it!

What is the purpose of bashing the op for buying a rubbish telly ?
Never, under any circumstances, take a sleeping pill and a laxative on the same night.

The OP is getting "bashed" for expecting the same kind of after sales service that might reasonably be expected for TVs costing much more and from retailers who offer a five year warranty!:D

What have you suggested constructively to the OP, exactly? All anyone has said here is what the OP can expect and that they are wasting their time holding out for a better offer and exaggerating the waiting time.

It's too late for the OP, but others should be warned off buying these supermarket cheapies, especially if they expect them to be long lasting.
The cheap components used are almost a cert' to fail as soon as the guarantee period is up (if not sooner).
  • Bashing me for having to buy a cheap TV isn't fair.. If I could afford a different make I would, we all cut our cloth accordingly.

The larger TV was only offered 2 days before Christmas, this wouldn't have arrived with us before the second week in Jan anyway.

They have now apparently confirmed the part is due next week and we are priority.. hopefully it'll get back to us damage free unlike it's initial trip.

Hopefully this now means i'll not posting in this thread and be "bashed" any more.

No one "bashed" you for buying anything. You were criticised for expecting a level of after sales service not in keeping with the amount of money you spent on the set and for deliberately exaggerating a three month wait into four.
If you had accepted the replacement set you would only have been waiting around two months-still a long time, but half the time you claimed. The delay was also down to a third party courier too.
Your repaired TV will not have an extended warranty on it's return to you and I suggest you start saving for another set in preparation for the inevitable failure of another substandard part not covered by the guarantee period.

Happy (but unlikely) to be proved wrong on this!:D

So the TV was broken before it went in for repair and was then broken again?
It may not be a top make but the sale of goods act States it has to be fit for purpose.http://www.adviceguide.org.uk/nireland/consumer_ni/consumer_common_problems_with_products_e/consumer_what_you_can_do_about_faulty_goods_e/faulty_goods_-_if_you_want_a_repair_or_a_replacement.htm

There was never any question of it not being repaired which is why it was accepted back in the first place. The TV was obviously not brand new, though.

The supermarket is clearly already exercising their duties under the Sale Of Goods act, but the long delay has been down to the courier and the wait for parts.

As already suggested, the most expedient conclusion to the problem is to accept the replacement offered or to negotiate a (partial) refund due to the age of the set.

I think this thread has rather run it's course now.

TV was damaged before sending back and then damaged in transit.
Not quite sure why they asked it to be sent back (which it was using the exact same packaging/polystyrene it came with) using a courier that they freely admit doesn't cover them for TV's over a certain size... Anyway the part is due next week and we're priority.. hope it's not damaged on the way back!

Hope it does get sorted out, but if not, I am sure your rights as a consumer are the same, it doesnt matter if its a TV, a laptop, a camera, or a microwave oven.

I would perhaps try posting your query on the "consumer rights" thread.

The OP will get the same answer on the Consumer Board. The supermarket can offer a repair, a refurbished replacement or a partial refund on an item which is not brand new.
They've so far done nothing which breaks the terms of the Sale Of Goods Act.

As I (and a few others) have said all along, the OP's best option would have been to accept the replacement offered.
