Asda Parking Fine

My daughter parked in the Parents and Children spot in Asda before Christmas. She was meeting with someone and then taking their child home with her. As it turned out she wasn't needed for the childminding. When she came out of the store she had a parking ticket for using the bay when no child was present. The majority of people have told her not to pay and to ignore any correspondence from the company. She listened to them. She has now received a letter from the company threatening her with debt collectors. Should she pay or not?

    This is probably the wrong forum for this, better to post in the parking forum.

    There is a great site/forum who deal with parking tickets they are called Pepipoo, worth looking over there.

    Basically as I understand it the old advice was to ignore, but now for some companies they advice appealing to POPLA. I think with car parks for shops the advice is contact the shop first to get them to cancel.

    I would post over on pepipoo and have a good read around the forum.

    Please read the NEWBIES thread (referenced in my signature).

    Who was the PPC? (Which company is referenced on the ticket)
    When was the incident? (Date)
    Where was the incident? (England/Wales?)
    Which retailer was this?

    As per the NEWBIES thread, the first thing is to not panic - THIS IS NOT A FINE! She does not have to, and should not, pay this!

    Second thing is to WAIT ... wait until she gets a Notice to Keeper through the post. (Assuming she is the registered keeper, and it is not a company or lease car).

    Only after the NtK is received does she look at appealing this and getting it quashed. (NtK should arrive between 4 and 8 weeks after the windscreen notice, so plenty of time to read the sticky threads here and get clear on what to do).

    How can the parking company prove any of this?

    Do they have evidence that there were no children in the car?
  • Per st999, there being no child is an impossible phenomenon to prove. Seen arriving with no passengers? Mr.Ticket Man must have counted the chickens before they hatched. From where did he know that your daughter's partner was not already inside ASDA with the kid, and that your avowed intention was to fetch them and drive them home. It is not beyond the realms of reality. The fact that it may not have happened is neither here nor there because he issued the ticket before being able to establish the full facts. Parent & Child parking was always a tricky matter for such reasons.

    Bottom line: you do NOT owe. No commercial or actual losses were inflicted on the landowner as a result of the action and the terms and conditions are void if they should mean anything else.

    There is NO need to reply to the windscreen ticket. As with the child issue, there is no recorded evidence that the ticket was on the windscreen when she returned, anybody could have removed it. Let the parking company wait the full 28 days and then BUY the keeper details from the DVLA.

    When the time the Notice to Keeper arrives, return to this thread and we will help you build a rock solid statement which will hit them for six. When they refuse it, it will go to POPLA and you can be sure that with the combined information you receive from us nearer the time, POPLA will cancel the charge.

    As above wait for the notice to keeper to arrive, then continue with this thread.
    You should be able to knock smart parking for six, and possibly ASDA for being stupid enough to allow a ppc onto their land for a little bit more.

    In a car park where I parked there was a bunch of kids taking parking notices off cars and throwing them around and winding up the parking attendant.

    The parking attendant then lost it and was screaming at them threatening to call the police.

    I got out of there.

    Hi I parked in a mother and toddler space in my local asda without a child present.I was going in to collect a child as I was minding him for the day but when I was inside I had a call saying he wasn't well and they wouldn't be coming.When I got back to the car I had a parking charge on the car window.I went in to see the manager (as I heard that they can stop these tickets) to explain but he wouldn't even come and talk to me.After reading many posts saying to ignore all correspondence I did but have now had the following letter through the door.Please can anyone help as I'm so scared and don't want debt collectors at my door and I'm not even sleeping at night worrying about it.I WOULD BE BE VERY GRATEFUL FOR ANY HELP RECEIVED.I have wrote what the letter contained many many thanks In advance.

    NOTICE TO OWNER-DO NOT IGNORE

    The Parking Charge Notice (PCN) issued which was fixed to the vehicle and detailed above remains outstanding.DVLA have confirmed that you are the registered keeper of this vehicle.Payment methods are detailed on the right and overleaf.(£70).

    If you do not make the full payment in full within 14 days (which is now 7 as I have had this letter a week already) the total amount outstanding will be passed to a debt recovery agent for collection.This may result in a summons or writ being raised for the recovery of the outstanding Parking Charge Notice and any further costs incurred.

    We believe that the issue of the PCN provides reasonable cause for us to obtain your details from the DVLA.However,if you believe your information has been used in appropriately you may contact the Information Commissioners Office or DVLA directly.

    To stop this possibility you should contact us before 12/01/2014.If you were not the driver of the vehicle and you wish to provide the drivers details,lodge a dispute,appeal or query this must be made online or in writing.Please follow the instructions overleaf.On a receipt of a formal appeal the Parking Charge Notice will be placed on hold until an adjudication is made.A response will be sent in writing.

    read posts #4 and #7 again, and wait for the NTK to arrive

    then appeal it

    as for debt collectors, nobody is going to come knocking at the door, I suppose they may do if it went to court, you lost, a CCJ was issued, and not paid after 28 days, then the creditor might take enforcement action

    so why worry about what cannot happen , a vampire may come in the night , but probably wont , so why worry ?

    all unfounded fears brought about by threatograms and designed to worry law abiding citizens

    so follow the advice of those 2 posts and write an appeal

    those parent and child spaces are just gimmicks by car park owners or shops, nothing "lawful" about them at all , they are just more spaces on car parks designed to make some people feel "special"
