Sorry if I'm a pest. I have drafted the following letter, could someone please let me know if this will be ok to send as an appeal or does it need tweaking at all.
As the registered keeper of the vehicle ---- --- at time of this charge following legal advice I wish to challenge this PCN.
My challenge is based on the assertion that your Parking Charge does not represent a genuine pre-estimate of loss to yourself or the landowner. In every case where a motorist has raised this issue against you,POPLA have accepted the appeal. You are therefore fully aware that there is no prospect of your charge being upheld. If you do reject the challenge and insist upon taking the matter further I must inform you that I will claim my expenses from you.The expenses I will claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees etc. By continuing to pursue me you agree to pay these costs when I prevail.
1.Your claim is not a genuine pre-estimate of loss.
If you reject this appeal I require within 35 days a POPLA verification code for me to appeal independently as per the requirements set out on the POPLA website, further supported by the BPA code of practice. You have been given the reason for the appeal above I have nothing further to currently add, and will not respond to any correspondence from your company unless it contains the POPLA code.Be aware that there will be formal complaints to POPLA and to BPA if there is no POPLA code on any rejection that you supply
Yours faithfully Mr Wellington.0 -
seems reasonable, but this is a standard draft stroma prepared and puts on here in order to get cancellation or a popla codeDear (insert name of PPC),
As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to you company is denied on the following:
1) this charge is not a genuine pre-estimate of loss
2) your signage does not comply with the BPA Code of Practice
3) you do not have the authority or permission to issue invoices at this location
These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of of your alleged loss, and your full unredacted contract with the landowner.
If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.
Please issue your cancellation within 35 days of this letter or supply a popla code to appeal to them.

Don't forget to make complaints to asda, smart are their agents, this is their land, you were a shopper, demand they cancel this stupid charge. Speak to the store manager and show receipts, also go for the head office if he/she is not helpful. When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

If you could sly video record them lying about not owning the car park, I am sure it would help a lot of people.

Make that your SECOND round of ammunition. Don't worry too much about the technicalities at this stage, your case is strong enough to defeat the parking company even if the charges WERE legal.
Let's stick to the basics, your accuser took a shot without establishing the facts. Now presuming the alleged offence is cited in the Notice to Keeper, here would be my first response (don't copy it verbatim).Dear Parking Company
Thank you for your correspondence dated xx-xx-xx containing your reference number xxx/yyy/zzz/000.
Your document alleges that my vehicle was parked in breach of your landowner's terms when having been parked in a bay reserved for parent and child.
Before I investigate your claim further, I will all evidence that you hold to testify that there was no child in the vehicle upon arrival at your client's property, and that there had been no child entering the vehicle upon departure from the premise.
Should you satisfactorily provide this information, I will look further into your claim. Note however that this does not mean I will be automatically submitting remittance, however I will launch a full and thorough investigation into whether your claim reflects losses suffered by the landowner.
Unless I am satisfied that you are in possession of evidence that one of the terms was breached, I have no further obligation to investigate your claim.
Should you fail to provide compelling proof that the parking bay was abused, you will be left with two options.
1) Destist and cancel the charge.
2) Issue a POPLA authorisation code.
To avoid your company future embarrassment, I would strongly urge the first option as the wisest. Naturally if you wish to waste your own time then you are invited to proceed with the second option whereupon POPLA will cancel the charge for you at your own expense.
Yours faithfully

Bid Bad Dad. Thanks for your reply. I like the example letter you have posted. Can you please tell me why I can't copy it verbatim and where the changes need to be?
I am beginning to panic now as time is running out to appeal. I have read so much on here and on the Peppipoo that I can't think straight anymore.0 -
Really? You really can't see that:
Parking Company = Put in the PPC's name
xx-xx-xx = put in the date
xxx/yyy/zzz/000 = put in the actual PCN refernce
etc.?
PS - I will all evidence should be I will require all evidence...and Destist should be Desist.0 -
That simple. I understood about entering my own details, but thought you meant to alter the body of the letter as well. This experience has really got to me. I know one thing: I WILL NEVER PARK IN A MOTHER AND CHILD BAY, WITHOUT A CHILD, AGAIN.
I cannot express how grateful I am for all your help.0 -
Hi everyone. My daughter followed your advice and, today, she received an email from the company cancelling the ticket. Thank you all for your help and advice.0
