    Custardy, as discussed in the previous posts this statement is incorrect under SoGA.

    What do you mean by convenient happy ending. Being messed around Asda and being given differing information from Asda over several weeks is not my definition of convenient.

    Also when returning the TV their was a couple in front of us with the same TV being returned for a full refund. They were on their 4th replacement.
  • They could easily argue loss of profit IS a cost, especially if it's a limited supply item.

    That is a very bold argument and could be use to argue against any replacements at any time which would be a big loophole in the SOGA.

    In my case Asda have and continue to stock the model so they could not make this argument.

    That is why I said 'could have'.

    My experience as a retailer is the customer will bring up some law/act. Said law/act doesn't exist at all, I have to tell the correct version of the law.
