Parking Charge Notice at Freeport Braintree

I have just received this notice by post today.

Entrance on 14th Dec @ 12.02 EXIT TIME 18.34

32 minutes over after our shopping food & film.

Charge Notice £100 If Payed in 14 days £60.

Issue Date ofthis notice is 31st Dec....As this is over 14 days from the parking date.....Should they have got the keepers details from DVLA ???>?

    Possibly not. But this isn't how you'll beat them anyway. Check out the NEWBIES thread for advice. The basic process is:

    Soft appeal to PPC (which will probably be rejected, so get a POPLA code. Advice and examples linked from NEWBIES)

    Winning appeal to POPLA (with forum advice - post your draft here for advice)

    Laugh at the PPC because they were stupid enough to try and scam you - instead YOU will have cost THEM £27 + VAT for the POPLA appeal. :D

    If there is a windscreen ticket then the Notice To Keeper must be delivered no earlier than 29 days & no later than 56 days after the date of the parking 'crime' i.e. not before 12th January.

    If there is no windscreen ticket then the Notice To Keeper must be delivered no later than 14 days after the date of the parking 'crime' i.e. no later than 29th December.

    In either case this Notice To Keeper is out of time.

    Which parking firm is it?

    From the Freeport Braintree website http://www.freeport-braintree.com/how-to-find-us
    Freeport Braintree shoppers who use the car park for more than 6 hours will need to extend their unlimited, free parking by visiting the Tourist Information Centre opposite Next Clearance to validate their ticket and avoid a penalty charge. Alternatively, you can pay to park for the day with the rates as listed below.
    Long Stay Car Parking Charges:
    Day £3.00
    Week £13.00
    Month £47.00

    So they want you to pay a penalty because you didn't extend your already unlimited parking or pay £3. The penalty is equivalent to the parking fee for 2 months!

    If it's a PPC like CEL then it is mentioned in the 'newbies read this first' sticky thread that some PPCs do not follow POFA 2012 (as so they can't have 'keeper liability'). Read the sticky threads including the 'newbies' one and the 'complaints' one - should answer all your queries and tells you what to do.

    You and this OP can tell from the Notice to Keeper whether it's POFA compliant, and that is covered...in that 'newbies' sticky thread already mentioned.

    Most newbies don't at first but once you know how to click to page one and read the sticky threads at the top, you will learn soooo quickly.     presumably you have found the newbies thread at the top of the forum ?

    the one you posted in and should not have ?

    ok , well read through it, click on hyperlinks (usually blue) to see what threads or posts they contain, as they are linked from that sticky thread

    now almost any questions you have are or should be linked from that main sticky thread as it contains virtually everything that is known about this subject, with links and templates etc

    yes its a lot of info

    yes its daunting

    yes it takes some getting used to and your brain is fried, so take paracetamol ;)

    try sticking to your own thread when posting as you dont know enough to comment in others and may cause them issues we dont want, or they dont want or need, they may be as confused as you are !

    hopefully when you have pieced together the rules of the game, the why it happened, the what to do about it, it may come clear
