    My opinion is that you wouldn't get back fees if you didn't wait for a cheque to clear, but I'm admitting that's just my opinion.

    I'm not defending Aquashambles, oh no, just not sure on the legal position.

    I read it that the cheque was dodgy with a wrong number, not a question of waiting for clearance.

    If it never cleared, then the money was never there to spend.

    The bank may charge the depositor for the dodgy cheque. Aqua are on the hook for such charges as it is their incompetence that caused it.

    Wow, in that case the charges should be recoverable. I've never heard of such an unfair charge being imposed by a bank. I've deposited one or two rubber cheques over the years and I'd be fuming if a bank charged me for someone else's bad behaviour when I had no way of knowing.

    Nor have I. I suspect that this is unfounded conjecture.

    Well last time I paid in a cheque that bounced was about 15 years ago and I wasn't charged anything then. Normally it's the cheque writer, not the cheque recipient that gets charged.

    Last time it happened to me was 30 years ago, and I was charged. About £20 I think. I got it back off the company that wrote the dodgy cheque. I can't remember who it was now though. The bank was Nat West, who I left a few years later as they were rubbish anyway. Been with firstdirect for 24 years now.

    I would agree if there are direct costs then that should be reclaimable.
