Euro Car Parks PCN

Received my first ever car park fine today from Euro Car Parks after a friend said it was cool to park there. So I parked my car, foolishly didn't read the signs and went to a local restaurant. ECP say that it was 120 minutes free parking and I overstayed by 40 minutes and the letter has camera shots of my car and the time of entry and exit.

Is it OK to ignore this?

    No - definitely don't ignore!

    All you need to know is in the stickies at the top of this forum but basically you will be appealing to Euro Car Parks as the keeper (don't say who was driving!), telling them that their charge is not a genuine pre-estimate of loss, their signs are inadequate etc.

    Then you get a POPLA code when ECP reject your appeal and you then appeal to POPLA where with our help you will win!

    And it is NOT a fine!

    Dear ECP,

    As the registered keeper of (reg) I'm in receipt of your parking invoice xxxxxx dated xxxxxx. I wish to invoke your appeals process as all liability to your company is denied on the following:

    1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
    2) Your signage does not comply with the BPA Code of Practice
    3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass

    These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.

    If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.

    Please issue your cancellation within 35 days of this letter, or forward a popla verification code.

    Sorry but what is E&W?

    And its says on their letter head that the are a member of BPA so I am assuming that their signs do comply?

    it doesnt make much sense to any newbie, but that is why you need to read and digest the NEWBIES thread by coupon-mad to get up to speed on this

    E+W means england and wales (the same laws dont apply to the other 2 countries of the uk)

    you never mentioned any dates , or other details, not location either

    it definitely will not say FINE on the paperwork either

    England and Wales. The law changed in October 2012 (only for E+W) which allows parking companies to pursue the registered keeper for their speculative parking invoices. (They are NOT fines, despite what they may try to infer).

    Don't beat yourself up! This is only ECP and they are easy to beat at POPLA.

    The thing is, I wrote those sticky threads as we cannot possibly tell people again and again and again the same old same old stuff every day. To an extent we still do, but at least the appeals process and how to complain is covered already. We were not keeping up well in the Summer, hence the Newbies info thread which forces new people to take ownership of their appeal using simple example letters & links for how to win.

    Everyone starts somewhere and they all manage it easily. Complete newbies like this person get them cancelled in days:

    Easy once you have read the main sticky info, and it's only a 2 stage appeal - and a complaint to a Restaurant Manager if it's their car park.
