Euro Car Parks PCN
Comments
-
Hello everyone,
So today I parked in a euro car parks and displayed my disabled badge, and returned to find a ticket for not displaying a valid parking ticket.
I thought it would be free however it did say no concessions for disabled badge holders.
What should I do? I have read a lot about ignoring them, writing a letter and so on and am not sure what the most up to date advice is. Please help!
I really don't want to fork out £40 for the sake of 10 minutes.
Regards

hi,
on 17th i got an Euro Car Park charge notice (CPN).
i was shopping in london colney and apparently i overstayed by 46 minutes.
I wasnt aware of this as its a non ticket carpark for the whole retail park.
Ive read some of your postings and want to be clear. Do I pay?
Obviously i dont want to pay the full £70 and have only a couple of days left to pay the reduced £40 charge-14 days from ticket, ive been on holiday till today!
Is this the reply (below) i send in the appeal section of their website. or am i in fact liable??
thanks loads,
Dear ECP,
As the registered keeper of xxxxxxx I'm in receipt of your parking invoice xxxxxxxx dated 17/7/14. I wish to invoke your appeals process as all liability to your company is denied on the following:
1) The amount being claimed is not a genuine pre-estimate of loss to your company or the landowner
2) Your signage does not comply with the BPA Code of Practice
3) You are not the landowner and do not have the capacity to offer contracts or to bring a claim for trespass
These points and others will be raised with Popla should you not accept this appeal, and you will be expected to provide a full breakdown of your alleged loss, and your full unredacted contract with the landowner.
If you do reject the challenge and insist upon taking the matter further I must inform you that I may claim my expenses from you. The expenses I may claim are not exhaustive but may include the cost of stamps, envelopes, travel expenses, legal fees, etc. By continuing to pursue me you agree to pay these costs when I prevail.
Please issue your cancellation within 35 days of this letter, or forward a popla verification code.

Please put this into a new thread of your own and we can advise you on that rather than trying to deal with two cases on this thread (and any number of others if other random people also pile in with their own cases) - much better for everyone. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
