2nd hand car 30 day warranty problems
Options
Hi, I'm looking for a bit of advice
Today I bought my husband a second hand car £3550 on debit card, it came with a 30day warranty for work up to £150 from a small local dealer the online advert described the car as "in great condition throughout" and "a great example"
I took the car straight to my mechanic for a full service where he found two problems which will cost around £600 to fix (totally trust my mechanic I've used him for my own car for years)
I called dealer and told him what had been found and asked if he would fix or if He wanted me to get it done and bill him
Obviously he wants their own mechanic to take a look and I'm dropping the car back with them tomorrow for their mechanic to look at Monday , he also said "I don't know if our warranty will cover that "
Now ideally what I would like to happen is that the dealer pays for the repair and my husband can get on with driving back and fore to work
But if dealer tells me their warranty doesn't cover the repair and they are not going to pay for it I will want to return car and have a full refund
So I would like your advice on my consumer rights
1) if they wont pay to repair Am I entitled to full refund and compensation for payment of the servicing, taxing car and setting up insurance policy
2) do I have rights to insist they pay for the repair / compensate me for paying for the repair ?
Hope I've explained this ok !
Thanks !

The faults are?
1. Depends what the faults are and the cars age and mileage.
2. No. You need offer them the chance to fix the faults. If they are faults and not just general wear and tear.Censorship Reigns Supreme in Troll City...0 -
Two problems....? Or two areas where components are slightly worn and need replacing some time in the foreseeable future?
Why didn't you have it inspected before buying?
In this price range most vehicles will have wear and tear! You may have rights if components are "faulty".
The dealer doesn't seem to be completely unreasonable in offering to pay for you to do repairs - subject to his own mechanic inspecting it!0 -
Sorry I don't know why I didn't put the faults in !
Power steering fluid leaking from
Corroded flexi pipe
Some wire mesh on the Middle and rear part of exhaust pipe has started to corrode (cant remember exactly on this one I haven't got the paperwork in front of me)
I'm perfectly happy for their mechanic to inspect that is not an issue
They have not said they will repair it
The car was inspected before it was purchased but these were not picked up until it was at our mechanics, everything else on the car is fine and we are not expecting a perfectly in order vehicle
Thanks for the replies0 -
It's a 59 plate with 46000 and mechanic said everything else is in good order0

And thats going to cost £600??
Somebody is having a laugh
I would expect the dealer to fix the leak, but £600 sounds way out.
Also, not so sure about wire mesh under the car being likely to be sorted out if its just starting to corrode and not a danger.
Let the dealer have a look and see what he says, but i really cant see him handing out £600 to your mechanic when he can no doubt get it done at a fraction of the cost.0 -
The "mesh on part of the exhaust" is likely to be fair wear and tear because it's a fact of life that exhausts deteriorate.
The leak from the power steering is slightly different, assuming it's a definite leak from a failed hose / pipe.
That would be an MOT fail under S.2.3.2 and / or S.2.3.3(b) of the MOT test manual and makes the car technically unroadworthy. Because it relates to steering, it also becomes an offence for the dealer to have sold it like that, under S.75 of the Road Traffic Act 1988.
Neither of those are anything to do with your "consumer rights", so the age of the car, price paid, an warranty and so on have nothing to do with it. The simple fact is that, if there's a fault with the steering (and a fluid leak is, by definition) a fault, then it was a criminal offence to sell the car without making it clear to you that it wasn't fit for the road.
How much MOT does the car have on it (makes no difference to the above, but may make a difference to what you can do about it)?0 -
They should fix the power steering leak, as the car was defective when sold.
They won't do anything about a corroded, but serviceable at the moment, exhaust.
As to the cost: a replacement new pipe from the manufacture will make your eyes water, the dealer will likely source a serviceable second hand one.
A £150 warranty? What will they fix for that? You would be lucky to get much more than a headlamp bulb change or a fan belt fitted for thatI want to go back to The Olden Days, when every single thing that I can think of was better.....
(except air quality and Medical Science)

Loving your logic here - there is a leak in the power steering system, therefore the car would fail MOT, therefore the car is unroadworthy, therefore the car shouldnt have been sold, therefore the dealer commited an offence.
Would LOVE to see you trying to make that stick.
Keeping it real here - its a cracked pipe and I would be fully expecting the dealer to sort it out.
HOWEVER i certainly wouldnt be encouraging the O/P to go in "willy waving" here about "committing a criminal offence", as its only going to entrench the situation.0 -
2 fairly minor issues. Nothing has failed.
How much powersteering fluid have you put in in the last 30 days? Max to Min isnt that great a quantity so i doubt the leaks bad.Censorship Reigns Supreme in Troll City...0 -
in last 30 days we haven't put any fluid in as we've only owned the car about 13 hours
Mot was done sept 13
Don't panic I'm not the type to go in ranting about criminal offences etc
If the exhaust is classed as fair wear and tear that's fine we will sort that
I was just wanting info as to whether or not the dealer is responsible for fixing the faults as I'm not in the know of my rights for buying second had cars
so I wouldn't want to sort it myself and be out of pocket if the dealer is responsible and also wouldn't want to complain and return the car if I am responsible for the repair
