Loving your logic here - there is a leak in the power steering system, therefore the car would fail MOT, therefore the car is unroadworthy, therefore the car shouldnt have been sold, therefore the dealer commited an offence.
Would LOVE to see you trying to make that stick.
Keeping it real here - its a cracked pipe and I would be fully expecting the dealer to sort it out.
HOWEVER i certainly wouldnt be encouraging the O/P to go in "willy waving" here about "committing a criminal offence", as its only going to entrench the situation.
The thing is, that's what the law says MG.
In most cases, whether or not it's unroadworthy in the sense of the RTA depends on whether its use would be dangerous. But the Act specifically prohibits sale for use on the road in the case of faults with brakes, steering or tyres. Being dangerous isn't a requirement.
There's no doubt that a cracked or deteriorated pipe is a fault, and should be an MOT fail if spotted. It's also part of the steering system, so the RTA S.75 applies.
Of course, you'd almost certainly have to take it to court to get anywhere with it, but a court would allow it because it's a simple matter of fact (a faulty pipe). and very clearly stated law (cars mustn't be sold with faults in the steering).
Had the MOT been more recent there would have been the option of putting pressure on through VOSA, but a pipe failing between mid Sept and now is perfectly reasonable so they won't want to know. But the dealer's responsibilities uner the RTA are different and require no faults with brakes, tyres or steering at the time of sale regardless of whether or not it has an MOT.
OP, I wasn't suggesting "going in ranting about charges" because that's rarely, if ever, the way to get things sorted. But it's worth being aware of the situation to help keep resolve if the dealer refuses to play along.0 -
in last 30 days we haven't put any fluid in as we've only owned the car about 13 hours

Don't panic I'm not the type to go in ranting about criminal offences etc
If the exhaust is classed as fair wear and tear that's fine we will sort that
I was just wanting info as to whether or not the dealer is responsible for fixing the faults as I'm not in the know of my rights for buying second had cars
so I wouldn't want to sort it myself and be out of pocket if the dealer is responsible and also wouldn't want to complain and return the car if I am responsible for the repair

I think the dealer should definitely sort out the leak, no matter should that be a £50 cost or a £500 cost.
