Currys Pay & Collect - Advice Please

Options
I placed an order with Currys Pay & Collect for a tablet PC on Saturday 21st December. Prior to placing the order, I ensured that the item could be delivered to branch before Xmas, as it was a gift.

I received all the relevant emails stating that order acknowledged, goods on route etc and then double confirmed with Customer Services that the goods had been delivered prior to collection.

To cut a very, very, long story short - the goods were not at branch. A pallet had been signed for, but not checked, and Currys state that the goods were placed on the delivery vehicle but never arrived in store!

To compound the issue, this item is now totally out of stock with no notice as to when it will be back in.

I have spent over 2 hours on the telephone to Customer Services (an oxymoron if ever I heard one!), only to hear that an investigation was launched, and then stopped (apparently becauseI had asked for a refund - untrue) and to continue being told that I cant be told anything further!!

This has now ruined the surprise of a Christmas gift, and is further exacerbated by the fact that I cannot give the recipient of this gift any idea as to when they will receive it.

A refund is not the answer, as Currys and John Lewis were the only stores offering this product at this particular price, and I would have to pay at least a further £60 to obtain it from another retailer.

Where do I stand, and what should Currys now be doing to rectify the situation?

Thanking all in advance

Currys don't have to do anything but refund you I'm afraid.

Why don't you buy it from john lewis?

That's a kick in the teeth. Will they get more stock in?

Personally I would have gone with john lewis first over currys.

  • Yes - a lesson learned, I guess. Do you know whether the 'time is of the essence' rule could be applied?

You could possibly claim under "loss of a bargain" which is something people like to bring up on here. The problem you have is if they have no stock and have no plans to get anymore stock then there is not really much you can do about it.

Get your refund, buy them something else, they wont be expecting it so it will still be a surprise.

    And then move on.....
make the most of it, we are only here for the weekend.
and we will never, ever return.
  • Not that simple, I'm afraid - they chose that particular item! It just infuriates me that Currys are basically getting away scot-free on failing to provide goods as promised - and the conflicting info that I've received from them since it all started to go wrong just further compounds the issue :-(
  • So you ordered an item to have it delivered to store.

However due to a mix up your item was not delivered. Currys have offered you a refund?

Not sure what else can be done to be honest! Its all well and good you saying a refund isnt an option, but what do you want currys to do if they physically dont have the item in stock!

The people you spoke to at first who said the item would be delivered in time were technically right - they wasnt aware an unfortunate mix up would happen.

Plsu Currys wont be getting away "scot free" - they will lose the money made from this sale.
  • The way that I look at it is this:-

My contract is with Currys, not any third party delivery company. If the delivery company have lost the goods, should Currys not be going back to them stating that they will now have to purchase the goods from anoter supplier at a higher price, and then claim the difference back from them?

I understand that there are certain elements of thsi situation that are not Currys fault - but the one thing that I am absolutely certain of is that none of it is my fault - yet I am the one that is losing out because of it.
