    Do you mean for council tax purposes or licensable?

    it is an HMO for both council tax and occupation (licence) definitions. However neither has any impact on the OP
    - the LL is liable for the CT anyway; and
    - whether the council has imposed additional licensing covering properties of this size (it is not of mandatory licence size) or not is no concern of the OP
