Really? The original post didn't mention the race or nationality of the alleged thief. However, as usual, some forum members leap on the bandwagon of either making assumptions about his race/nationality or predicting more crime in the future or claiming that this sort of crime originated in Eastern Europe (as if nobody else had ever thought of distracting the victim). What does any of this have to do with the initial question? Absolutely nothing except that some people can't check their petty xenophobia/racism at the door of any thread. I find that offensive and am slightly surprised the forum moderators don't too.

My questions are: Are Subway duty bound to ensure their customers are safe while eating on their premises? Are they obliged to ensure their CCTV cameras are operational at all times? Can we make a compensation claim against Subway for the loss of our daughter's phone?
Any help and advice would be much appreciated :)

Yes; Subway have a duty of care to all their customers on their premises in regard to their safety; it does not extend, though, to ensuring the safety and security of the possessions of the customers.

No; they are under no obligation to ensure their CCTV cameras are operational at all times.

No; you cannot claim against Subway; because Subway have no liability or responsibility in these circumstances (See first answer).

I would advise your daughter to ensure her (next) phone has a PIN; and to consider insuring the phone against accidental damage or theft.

It's not racism to suggest that a particular ethnic group are responsible for things they are responsible for.

You're going too far in my opinion and instead of trying to argue your case and taking the thread way off topic you should simply report the posts which offend you and see if admin agree.

If you had insurance, they wouldnt have paid out with the phone sitting on the table
    personal responsibility!

    Unlikely to be true.

My travel insurance agreed a claim arising from a similar incident in Starbucks in Barcelona (electronic goods removed from the table in front of me while I was distracted). For the phone to have been unattended, she would have needed to go to the loo or to get sugar or something...

I find it's easier to just ignore the racists ....their posts vanish quickly enough as so many people are fed up with them and report them anyway.

OP if your daughter is a first year at Manchester she'd have had all the warnings about not doing stuff like this less than three months ago. It's a shame but she certainly shouldn't be trying to shift the blame to Subway.
