Is a phone 'unattended' if its on a table infront of you and you are sat there?

I am not saying you are wrong, just interested if that is considered as being unattended.

Yes; I'd have said so. It should have been in a zipped-up bag or pocket, out of sight and not on a table. It would have been equally easy for the OP's daughter to accidentally knock the 'phone onto the floor and smash it.
  • Surely the only person at fault is the thief, definitely not subway. Leaving a phone on the table makes it more attractive to thieves but you don't deserve to have it stolen.

If she has the box, it will have the imei number on, so she can at least have it blocked.

Just like ipads, that are not new but just to apple people follow like sheep
Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

A homeless man appeared over her shoulder and distracted her by shoving leaflets into her face.

I am intrigued as to how she knew he was homeless, did she ask him, or perhaps he had 'no fixed abode' on his forehead?

Sadly we live in a world where it's not safe to have your valuables on display.

It's not the girl's fault that someone stole her phone; that's the fault of the thief.

But she's learned the hard way that you really need to take care of things to avoid them being taken by some enterprising toe-rag.

It happened to me in my early teens - I was counting out some money outside a cinema and a gang of youths stole it; there was a fight and I got it back, but it ruined my day.

Unfortunately you have to be extra careful of all your belongings nowadays. Don't leave handbags, briefcases or laptops on the floor, especially in cafes, restaurants or other places where people can move freely around you.

You've also got to be extra vigilant with high value items like laptops, tablets, phones, purses and wallets. Leaving them in plain view on a table in front of you is just asking for trouble, so is walking down the street texting or listening via earphones or earbuds. Even holding a phone out in your hand is an open invitation to those who feel that they should have your possessions.

High value stuff should be either left at home or keep secure in a pocket or handbag (with a strap across your body, not just over you shoulder). Stuff like iPhones which are obvious high value items are particularly vulnerable as they are easy to steal and very easy to sell
Subway cannot and will not accept any responsibility for personal possessions

So I think with all the replies you now the answer is No Subway are not liable in anyway.

Sadly this is something your daughter has to take onboard, any valuables must always be kept on your person, not even an handbag is safe to put on the table when eating.

My daughter had hers snatched whilst sitting eating outside a London restaurant, it was on the table in front of her, when a man ran past and snatched it, I was horrified to learn later that she chased him along with a friend and a couple of waiters, thank God she didn't catch him, possessions can be replaced, lives cant.

Theft is nothing new. Someone stole my handbag in a pub 30 years ago.
