My neighbour's are going to build a 4.8 metre extension under the new laws!!

  • Angie - I remember being in a similar situation to you. A well meaning friend (who is a surveyor) advised me against using the Party Wall Act because it gives the neighbour rights to access your land. Because of this I hesitated to use the Act and regretted it for the next three years until I had to pay through the nose to have a boundary amended just so I could sell the house.

    You have a least already found out that your neighbours don't give a stuff - the gloves are off now. The Party Wall Act is the ONLY way to go - forget about contesting stuff with the planning department, the building will be up before they've got around to telling you that there's nothing they can do about it and it's 'beyond their remit' etc. I wish I could go back in time and give myself this advice.     Do you have a party wall agreement signed yet.

    If not get to a solicitor and get an injunction NOW. If they have dug out the footings and part of your property has collapsed then their builders sound like cowboys.

    What more damage will they do. Wind damage, yeah right
  • I printed off the party wall act last night and approached my neighbour. He was very sorry for the damage and assures me it will be sorted out. I've also spoken to the planning dept and building control. Thank you to all who gave me advice...I did listen and act on it. Building work only started two days ago so I'm not sure for the reason for the critism? I am a mum, I have no experience of building law that's why I came on here. End of.

    might be an idea to get over to garden law website as they are a bit more experienced in this sort of thing.

    Also get your own surveyor, don't use theirs, they will be paying for them anyway under the party wall act.

    I would still plan on getting an injunction if they decide not to sign the party wall agreement before carrying on. If they decide to carry on without a pwa then an injuction is your only option.

    Make sure you see the plans and check that guttering etc will not overhang the boundary. If it does then objecting after it is built will be a complete waste of time.

    PWA should be sorted out before any work starts!

    You need to protect your own property - your neighbour obviously doesn't care.

    You got good advice on PWA at the end of December, which you acted on yesterday and acknowledged today.

    That's the reason for the criticism, and some speculation regarding whether this was a real situation.

    However, better late than never. :)

    There are plenty of mums who do have experience of building law.
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales
