My neighbour's are going to build a 4.8 metre extension under the new laws!!

    I'm reading the OP slightly differently, it seems, to most.

    It sounds to me as if PP has been applied for, then the OP's verbally objected to the planning officer on a site visit, who's said "Look, I can't comment on this..."

    A verbal objection's worth nowt. The OP NEEDS to object formally. The application, and the route to lodge that formal objection, will be on the LA's website.

    Is objecting to a build on a right to light basis a dispute? I wouldn't say it was, and anyway, it will be resolved, one way or another.

    When two neighbours of mine objected to a third neighbour's proposed dormer window they called it some rather rude things on the council's web site. This wasn't a dispute, just people expressing their opinion of the shape/size of window chosen. The three are still on good terms.

    i think pinkteapot's post about declaring a dispute was in response to the OP mentioning writing a solicitor's letter. I would say if this happens it would be termed a dispute...
  • I did write to the planning dept raising my concerns but this obviously didn't constitute an objection :/ I am annoyed for the following reasons:
    A) their right to build this overrides my right to enjoy my garden now..whilst they dig their footings over my side, and in the future when there will be no where on my property to escape the smell and noise from a neighbour(aren't gardens supposed to be our own little sanctuary?)
    B) the planning dept have done nothing to help ie passing on my concerns to the neighbour
    C) I resent the ' we can do what we like attitude' what happened to common curtesy ?

    Why don't you make an extension too?

    If the roots of the trees and plants have made their way onto your neighbors property then they are within their rights to destroy them to enable the build...

    I don't know where she thinks a solicitor's letter will take her anyway.

    People have pointed out that the only useful things the OP can do are:
    • object on the basis of loss of light in her property
    • get a surveyor working for her through the Party Wall Act and have the extenders pay for his/her services.
    Presumably, the council have already looked at the first of these. The OP hasn't really made this clear.
    It would not be appropriate for a council to pass on the OP's concerns to the other parties..

    indeed i dont think the OP has gone that far themselves even...

    that would be my first step, under these circumstances..

    What difference will the extension make to whatever noise and smell already exists?
    If the extension is full-width, it'll only move the source of them back by approx 15 feet, whereas if it's not full-width (i.e. they're going to have half the garden remaining on the opposite side to you) there's a fair chance that it would actually mask them more than now.
