  • Sorry it didn't let me add the photo because I am too much of a new member. Understandable but now not sure how to add it?

Basically the letter says to stop contacting ECP and to contact the DRP instead as it's been passed onto them. They have said they will accept no further correspondence from him regarding this.

They said they have received the appeal from the driver (me) and responded in September and that I ignored it (I sent bank statements which they deny receiving).

You can show us the letter by removing the http:// and putting a gap in the URL.

ECP are saying in this letter that the driver (me) already appealed - so how can they legally still be sending the letters to my partner knowing he wasn't driving? And the debt was passed to the collections agency in his name not mine. ANd I didn't ignore them - I sent my bank statements which they deny receiving!
You should complain to the BPA Ltd., using Steve Clark's email addy in the 'NEWBIES read this first' sticky thread. NO they cannot write to the keeper once the driver is known, and they should have replied to your appeal and evidence with a POPLA code., The BPA can lean on them.

  • Thank you.

They did reply to me, the driver. But they say I ignored them, bringing the responsibility back to the owner. I didn't ignore them but I have no proof of this. Stupidly, I sent off my bank statements as requested and thought that would be the end of it like they said it would be :(

That is unlawful, they knew you were the driver and had received something from you. So, they CANNOT revert back to the keeper.

Time for a BPA and DVLA complaint email!

  • But they are saying they didn't receive it. Does that make a difference?

Whether you ignored them or not they knew full well that you were the driver.

So don't panic, you are getting good advice on here.

    Nope.

Also you said 'ECP are saying in this letter that the driver (me) already appealed'. So you are saying that they HAVE already had a letter from the driver, so they know you exist and who you are.

Stop dithering (sorry, I tell it like it is!) - time for a BPA and DVLA complaint email!

  • Thank you. I will write my complaint tomorrow and get it sent off.

What do I do about Debt collectors in the meantime? As they are still on my case. Do I ignore for now or will that make it worse?
  • Please help. I am so confused reading all the info about sending off the complaints and I don't get exactly who to send it to or what to say exactly. We now have a letter from another DC Called ZENITH collections.

I am 6 months pregnant, in and out of hospital, have 3 children at home and just mega stressed. I can't think straight and can't make sense of all the info as my head is all over the place.

Hubby getting stressed about the DC letters, threatening court action.

I am very ready to stop messing around and get serious with this.

Although they have lowered the cost to £50 and tempted to just pay it to stop further stress.

I would be really grateful of any further advice, I know I should have sorted this by now but just got so much on. :-(

Zenith Collections are Debt Recovery Plus, just another desk in the office, and another link in the chain of this scam. These lot of scum never do court! The debt collectors are utterly powerless and can't do anything apart from write letters.

Think about this logically, if they are serious about going to court, why almost 5 months later they still haven't ? The answer of course is that they have no intention in going there, continue to ignore.
