  • I have today received a letter from PE. I defended CC claim and made a WPO to PE for £20 to go away; they want £50. They have rejected my offer as below; any suggestions?? Tow of the 4 letters they state they sent were not received by me and I certainly didn't receive the LBC

    Thank you for your correspondence in relation to this matter,


    Thank you for your without prejudice offer of £20 as full and final settlement of this claim. However we must inform you that we are unable to accept this offer.
    In your correspondence you state that you received 2 letters in relation to this charge, and that you did not received a Letter Before Claim. ParkingEye can confirm that a 4 letters were issued in relation to this charge, prior to court proceedings being issued on ... Our letter issued on …was our Letter Before County Court Claim. All this correspondence was sent to the same address as the correspondence you have received, therefore we believe on the balance of probability all the correspondence was delivered and received in the normal manner.


    In our correspondence dated 23/01/2014 we advised that had you corresponded with us earlier and providing proof we believe that we could have resolved the matter prior to court proceeding being issued. All our correspondence provided you with the details on how to appeal. As you chose not to do so a County Court Claim was issued and further costs have now been incurred due to your inaction.


    This notwithstanding ParkingEye are still willing to accept £50 in full and final settlement of this claim and do so on a without prejudice basis (save as to costs). We have extended this offer for a further 5 days from the date of this correspondence, and must warn you if this remains unpaid the claim against you will remain in its entirety.

    Powerlady - have you received written confirmation from ESH or Rishworth that the original parking charge has been cancelled - has this been confirmed by parking eye?

    Did they provide a breakdown of their costs?

    edit please confirm the above power lady - I'll work on a letter to send.
  • I have emails and correspondence from Matalan requesting cancellation and their letter confirms I was a genuine customer. They are happy to reduce from £100 to £50 but their charges are:
    Issuing Court Proceedings £15
    Cost of obtaining RK details from DVLA £2.50
    Postage £2.50
    Admin costs £30.


    I have offered £20; they have declined. I have only received 2 out of the 4 letters they have supposed to have sent me. They waited 168 days from original PCN to issue me with County claim - just before xmas!!!
    I wanted to send you redacted copy of the letter but am having trouble converting it to word so that I can copy text for you. Is there another way for you to see this;, although it looks a fairly bog standard template letter...

    Those costs are typical and yes template letter number Eye01 I believe.
    It is funny that in every case that they proclaim to have sent four letters to each and every person. It is also noticebale that numerous complaints have been made that letters have not been received.

    Email them and request a breakdown of their £30 admin costs

  • yes please, but still need to send an attachment of the letter so that you can read their original. I have all the copies of the letters and originals.
