    I do not want to drive anyone away, I am against the proliferation of PPCs as anyone, but, having dealt with people in trouble for a large part of my working life, I stand by my opinion.

    If people were not so stupid, would Wonga be as successful as it is? How about Brighthouse? Why is debt so high? Why do we have the most expensive railway fares in the world, and why do people walk along sea walls during tidal surges.

    There is poor old coupon mad mum spending hours and hours on here helping out people who just will not help themselves? She is entitled to sound off occasionally is she not.

    That is down to coupon how she handles things, but my post count is over 5300 today, that in a little over a year, so I spend quite a bit of time on here helping people.

    As for the other stuff you mention, until you've spent time out of this country and seen at first hand what other cultures do, don't put the country down so much. I was in a country a little whole ago that certain people were trying to overthrow the government in a coup. I was looking out of my window where tanks were shooting at the parliament building, then watching it on cnn.

    So not everything is bad, and when you get some perspective by seeing it through different eyes you'll be thankful on what we have. Finally just to say on this matter, most people who come here for the first time has never been to a forum before, so don't know the first thing about how things are done on here.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    Oh. but I have, 33 years in the Diplomatic Service, woken up to machine gun fire in Dacca, spent a week shredding documents in Lagos as we expected the High Commission to be attacked by a mob, been spat at by a White Rhodesion in Lourenco Marques, my knees are well and truly brown.

    Well you should be able to see this with a little perspective then. I spent 8 years in Russia, my 2nd month there the government soldiers were shooting out the rebels in the White House (Russia parliament building) I was across the river watching it. I was arrested 3 times and beaten up by some soldiers because I was walking to work. I lived under curfew for about 2 months. It was fun!

    Still this rant about what newbies do is really a minor thing, most will follow the rules

    i am a guilty "newbie" who read a bit (but not enough) and posted then went back and read the stickies and am now getting my act together.

    you two (stroma and the deep) should get a room - lol! why use this thread to exchange war stories? not helpful and a good reason why newbies post first and read later - because you've populated these threads with so much additional bumpf!
  • Bumping this thread up as Powerlady needs to get her skates on in filing an acknowledgement to defend and step up a gear.

    Start complaining also to the landowner/shops urgently.

    If large retail site then google or say which one - we can probably direct who to complain to eg Savilles ESH etc.

    And start researching/compiling defence around for example this bullet
    point list:

    Defence bullet points:
    • Contract between Parking Eye and landowner (not a signed witness statement)
    • Proof in contract that parking eye have a proprietary interest and are legally able to purue parking charges on behalf of landowner.
    • Documentary evidence that Parking Eye (or landowner) are not in breach of any local planning regulations particularly parking times and installation of ANPR system.
    • Evidence that the ANPR is working accurately and correctly callibrated.
    • Documentary proof that parking eye are complying with legal obligations particularly in respect with paying business rates for the car park in question.
    • Amount charged does not respresent a GPEOL for the alleged contravention - Request a breakdown of the parking charge for this loss. (Normal business running costs are not applicable but parking eye quote these - suggest in court that many of these are also tax deductible expenses)
    • Tailor any other points e.g regarding signage - did you see it -
    • Were there signs at car park entrance - you cannot enter a contract if you were unaware of its existence.
    • Were the terms clear etc to you - you could bring in the fact that you were able to park with the landowners permission under the existing obligations between the landowner and the motorist which enabled you to park without any conditions or charges imposed upon you.
    • Do you or anyone with you on the day come under any of the protected characteristics of Equality Act ....

    I would add in that proof the ANPR meets VCA approved standards for use as court evidence in the United Kingdom and site examples of Local council evidence in Civil penalty cases having to meet VCA ANPR standards of timekeeping.

    This point only needs to be picked upon by one District Judge and Parking Eye are dead in the water.

    Add it in to all defences, let the bargain basement could not make the grade agency solicitor answer that one.

    Haven't a PPC (PE? VCS?) already lost a court case due to non-conformance of their ANPR system?
