UKCPS Ticket

, the rules for parking (on the tickets and on the signage probably too) will state that the ticket is not transferable

Do you know what that term means? It means you cannot take it from one car park to another and the idea that it means it cannot be used by more than one vehicle is the parking company bullsh*tting and taking on terms used by authorities. Councils have more car parks than you can wave a stick at, so if it says "King Street", you can't suddenly drive to "Princes Square" and use it on that car park just because it is still valid.

But parking companies? A different game. The OP doesn't need the ticket because its deployment is not the source of complaint. UKPC believe their "condition" means one ticket per car. In reality, it is one ticket per space for the time scale and you in turn can park as many cars as you like so long as it is one space taken by one car and all before the expiry.

In light of this known terminology, I don't believe courts will buy this yardstick. Think about it, if you drive in with your MG and buy a ticket for three hours; go out after 20 minutes and return an hour later in your Rolls Royce, what have you breached? YOU bought the ticket...how to UKPC know that OP's daughter doesn't own both cars?!
  • Onward from last post...

Council tickets will specify the car park on the voucher. It has never been the case with councils that a ticket cannot jump from one car to another....except when the registration needs to be produced on the machine. In this case it will be printed on the ticket, creating a type of "permit".

Did the UKPC ticket have a registration number on it?

almost all the car parks around here need you to input the vehicle reg number , both private and council, so creating a "permit" for that vehicle to "park" on that car park and only that car park, so its not transferable because the next car it appears on (like the one in the opening post) will not have a vehicle registration logged against the anpr cameras, this then produces a parking charge , which was the point of my reply

my reply was not designed as a court defence, it was an observation that in my opinion this is what caused the op or her daughter to receive a parking ticket

should they wish to go to court and debate the issue in the manner you describe, I have no objection to it, or if you did the same

my point is that if you do not pay for the "right" to park, and do not follow those "rules" of parking, its hardly surprising that a ticket comes in the post !!

the infamous PEEL CENTRE near me has even been on tv over issues and anyone who parks on there and doesnt put a reg number into a parking meter is going to receive a PCN from Excel in the post, no doubt about it !!

one thing you need to bear in mind here, is that not every post being made is going to be going to court and needing a better defence like you may need next month

but anyone naive enough to try to save £5 in parking fees under these anpr + modern reg number parking meters is going to come a cropper , and near me that includes ashton retail park , peel centre stockport , ashton town centre council car parks (various) , hyde town centre council car parks (various), tameside hospital , Mcr Royal Hospital , and many , many others besides

in all the cases I cited on car parks near me, the ticket has the reg number printed on it, and is not transferable - PERIOD !

its also a fact that they clock the car in and out using anpr, then check the ticket machine for the reg number, and issue tickets when the 2 do not tally (especially on the PEEL CENTRE in Stockport) , most of the larger PPC`s use this anpr + p+d ticket machine (with reg number input) method for car park enforcement and many retailers may have a machine within their actual premises where the reg number has to be put in to be exempt from any parking tickets, like hospitals etc

not only that, if you go out of these car parks, they generally state NO RETURN within 2 hours, especially the private ones. this is why the prankster loves to bait highgate with his "double dipping" of the car parks in his local area ;)
  • I confess I didn't read the full works, I scanned through. That's what happens when threads become longer. In this case we have a registration (assisted by ANPR) system so what I stated does not apply - but my point was certainly correct for other situations whereby the parking company might like to play the opportunist.

Oh well, there is still the argument of genuine pre-estimate of loss if nothing else.
  • Just having a very quick catch up, thanks so much everyone, will need to digest all the info. The ticket did not have the previous cars reg printed on it, and yes no ticket on windscreen, letter in post. Phew !

ok , well this tells you what is going on https://forums.moneysavingexpert.com/discussion/4835943

and as its a postal NTK then it has to be received within 14 days so check if that has happened

assuming it has , send in this soft appeal
Dear (change this to name of the PPC)

I am the registered keeper of ( reg) and in receipt of your notice to keeper xxxxx dated xxxxxx, all liability to your company is denied, so as the Registered Keeper I wish to invoke your appeals process on the following:

    1) This charge is not a genuine pre-estimate of loss
    2) You do not have the authority or permission to give these invoices to motorists
    3) Your signage is inadequate, and does not comply with the BPA Code of Practice

You are therefore invited to cancel this charge now, or supply a popla verification code to appeal to them on rejection, where you will be asked for a detailed breakdown of the above. As you know all appeals on the points above are upheld.

Please confirm cancellation within 35 days of the above date

    Faithfully

    The registered keeper
change the name of ppc and reg adding in your RK details

ensure the driver is not named, deal as RK by getting the RK to send in the above in response to this NTK
  • Thank you so much Redx, I will do that, will keep you posted on progress

Always ensuring that you use the phrase "registered keeper" rather than the common shorthand used here - RK.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
