replacing faulty tv at sale price or reg price

Bought a Samsung tv at Tesco only on Friday and had developed a fault.

Tried to replace it today and all they could offer was a different spec tv but not as good, or my money back.

I do want the replacement.
This sells on Tesco direct at original price which I prefer.

Surely this option should be available to me?
There is a delay on shipping though until after Xmas.

The original value was 379 but got it for 249.


At what value do they put the tv at? and I assume this is discretion from the manager.

could they value the tv at 379 and myself pay for an upgrade??

    how much did you pay for the faulty TV ?
    what is the current selling price of the one they are offering as a replacement ?
    why are they saying they cannot replace with the same model as oroginally sold to you ?

    They could do if they wanted to. They could give you a £1000 TV for free if they wanted to.
    But I doubt that they would want to.
    If they do give you £379 off another TV that would be through their goodwill.

    Isn't Tesco Direct run as a separate company from Tesco stores? So what they've got on the website isn't necessarily stock that the stores can get.

    Correct me if I'm wrong, I know some companies work like this but not sure if Tesco was one of them.

    hi i paid £249 reduced from £379 in the sale weekend.

    all they said they could do is take a toshiba at £299 or refund £249.

    i refused both and took the tv back.

    to me I am looking at a TV at £379 not £249

    In which case I suspect they'll have twigged this and will happily refund you your £249 leaving you to search for a replacement

    All you are legally entitled to is the money you paid out for the television you bought.


    If they are offering you a tv at £50 more than you originally paid then you are £50 up on the deal and more than you are entitled to.


    Just curious, why is the Toshiba worse than the one you got. Personally, if the first tv developed a fault in such a short time, I would avoid getting another one like the plague.

    You are entitled to your choice of repair, replacement or refund.

    However the supplier is also entitled to refuse a disproportionately expensive option, which in this case would be the replacement

    Where goods do not conform to contract, you can outright reject them for a refund where acceptance has not occurred (its the only time a consumer can really demand a full refund). If acceptance has occurred, you can request one remedy over another but they can refuse if it is disproportionately costly.

    It will likely be disproportionately costly for them to give you a replacement instead of a repair or perhaps even a refund.

    However, if they are only willing to repair or refund, you can always take the refund then rebuy the tv if you're willing to put the excess towards it.

    there is a big difference in spec to what I want and to what I pay my money to.
    as for this TV it was just a bad egg, you get them now and again.

    As for the TV I shall see if I can upgrade at all:D

    i am not too sure on a repair that's the same as paying for a refurbished second hand model
