What are my rights? Seller does not accept returns.

I bought a pair of BN boots from Dorothy Perkins from a seller with good feedback, on about the 23rd of Nov; and despite only a handful of times of having them on the heel has come away, and the other looks to be doing the same. The seller says they don't accept returns; but surely these are not fit for purpose, and should not be falling apart to this extreme in such a short time. I will upload a pic shortly when on my phone to highlight how bad the problem is.

  • Open a case, ebay will tell you to return for a refund. No returns means nothing. Ebay ignore the returns policy.

    A private seller. I did contemplate the resolution centre tonight but then wondered should I contact the seller first to be polite.
    Can't figure out how to upload off this new mobile as need to go through photo bucket or such like; but it's a right mess. I wonder should I email a pic to the seller after opening a dispute?

    Ah. Yes, contact them first. I thought you already had and they said no returns. Remember that selecting a reason for contact automatically opens a case now.

    You could send a photo but if it's trouble to upload see what they say and offer to send a photo if they want it.

    1/ Ebay automatically put no returns until seller changes it. Many don't - especially new ones.
    2/ No returns means you cant buy, change your mind and return - it has absolutely nothing to do with damaged / faulty items.
    3/ Ebay buyer protection means you can return within 45 days.

    And above all else - CONTACT THE SELLER FIRST!!!!

    I bought a second hand microwave on Ebay, picked it up, the clock was on but very stupidly I didn't check full operation as the seller said they had used it earlier that day.

    Got it home, cleaned it and although all the functions work the turntable does not rotate which obviously makes it useless as a microwave. Seller is refusing any sort of settlement and ebay say as it was cash on collection not paypal that it is hard luck. Beyond negative feedback is there anything else I can do?

    (Total cost was 40 quid, petrol to go round and have it out with them would be 20 quid so doesn't seem worth it)

    No. Cash on collection, sold as seen. Sorry but you should have fully checked it. Never take someone elses word because you have no comeback and people lie however nice they seem.

    I don't think there's much you can do. When collecting items, you really must thoroughly test them before taking them away.

    All the seller would have to say is that it was working fine when you collected it, and you must have dropped it on the way home, or something like that.

    I think all you can do is console yourself it was only £40 plus petrol, and not hundreds.

    Thanks - what I thought and I know I was stupid, it was one of those 'it is late, kids are in the car and hungry, seller has a nice house and looks middle class' thangs.

    Obviously very easy to see with hindsight but if I were selling I'm not sure it would be worth scamming someone for 40 quid, especially not for cash on collection where the buyer might be very local. You live and learn.

    If I name and shame them (eBay name only) on here or elsewhere am I opening myself up to any comeback?

    £40 is quite a lot to some people. Perhaps in paying for the nice house they need cash for other things or maybe they got that nice house through scamming others.

    If you name them you may find your post gets removed and if they happen to find it it'll be pretty obvious who named and shamed them.
