Didn't recieve first Notice to Keeper

PCN (ANPR) From ParkingEye @ Aldi in Poole. Overstay (10 minutes)
Overstayed at Aldi for 10 minutes (am both driver and keeper) - but I didn't receive the original PCN (Notice to Keeper) and only got the reminder on Friday.
I have read through the stickies (thank you very much) but couldn't find anything covering where the first notice I received - it would seem to be after the 14 days that they need to notify me
However I can't believe a claim based on "didn't get it" would work so should I use this at all
Secondly - I did use Aldi (twice at it happens) but receipts will be hard to find. Should I mention this if I don't have any evidence

The reminder normally arrives after about 14 days from the NTK and still within 28 days of the event. So just go online and do an appeal like you will have read about in the 'NEWBIES read this first' sticky thread.
Do that now - and mention that you never received any PCN at all and that the reminder is the only letter received. See the Parking Prankster's blog, PE have postal problems:

When I received your reminder letter dated 02/12/2013 I discovered a parking charge notice had been issued for my vehicle`s stay on that car park whilst out shopping there. The PCN was for exceeding the 90 minute time limit allowed for shopping there although this was poorly signed as it is not a pay and display car park and no tickets are bought or issued and so no display ticket is ever shown or received.
I would note that I live in a detached house with good postal service, and I did not receive the initial Parking Charge Notice. Unless you can therefore prove that you sent that letter you have written outside the 14 days after the incident which you are allowed to lawfully proceed.
I believe my vehicle is not in breach for the following reasons,
* The driver visited Aldi for shopping purposes
* The driver only stayed within the shopping complex
• They did not realise on that day that the vehicle had overstayed given the difficulty in parking and the poor signage
In light of the above I request that the parking charge notice is cancelled accordingly to promote goodwill between a legitimate shopper and the businesses on that complex who pay rent and other charges to the landowner.
However, I must point out that if you were to not grant my appeal I would require a POPLA reference as I would appeal to them in the light of the sincere intentions above, and I would also be asking them to cancel the parking charge notice as I do not believe the punishment here fits the "crime" and that the fees incurred are such as to attract a profit and not a genuine loss. These details will also be considered when I submit my POPLA appeal as most pay and display car parks feel £2 to £4 per hour are reasonable to cover costs, not the £420 per hour charge that your penanlty impliesI think I saw you in an ice cream parlour

I am the registered keeper of the vehicle in question and as such am exercising my right to appeal against your parking charge.
On the day in question, the driver entered your car park and drove round looking for a parking space. They then parked for just under 1 hour ( or whatever the time limit was). Being polite, they then waited their turn and merged with other drivers and left the car park. Their overall parking time was less than the time on your signs.
You will be aware that the BPA guidelines require Parking companies to allow a certain grace period for such eventualities and 10 minutes is not excessive.
In view of this - not to mention your charge exceeding any genuine pre estimate of cost - I would be grateful if you would cancel the charge or, failing that, send me a POPLA code so that I may appeal on these and other grounds to the ajudicator.
As I said, registered keepers have the right to appeal and you were reminded this by your association last month, so any failure to cancel or provide a POPLA code will be reported to the relevant authority.

Mark88man please let us know what happens here -even if they cancel.
If you receive a POPLA code come back and start researching and post up POPLA appeal before submitting.
If they neither cancel or issue a POPLA code come back and inform us.

Hello all - I will resuscitate this thread rather than start another. Just heard back from PE - they have rejected the appeal but given me the chance to pay at discounted rate for another 14 days.
They have provided a POPLA reference.
Grateful for your advice about what happens next and what I should be doing

you should be sorting out your popla appeal (which you should have been sorting out ever since your soft appeal went in) , then post it here for checking (with no personal stuff in it)
the sticky thread gives you the walk through and links to templates etc
tells you all this in post #7 too
ps:- you should have also been complaining to ALDI too0
