Question about cars

Yes, moving a car that doesn't belong to you is against the law, but, REALISTICALLY, I can't see the OP getting any comeback if they chose this path.

I agree with the letter giving them a deadline, but no one will remove a car without the proper paperwork. Therefore if I were the OP and there was no word after the deadline, I'd just move it on to the road. No need to break in to it to take off the hand break, just get a posse of friends to help you lift it!

If the OP moves the car into the street, what happens then? It's not for the Council (taxpayer's money) or police (taxpayer's money) to sort it out so the car just stays there?

It's murky waters and the OP could get landed with a bill or a fine.

There's a few things here, it depends on how you want to deal with it.

It was not part of the goods to be left, therefore the seller is in breach of contract and can be sued. Your solicitor should be chasing this up for you.

You could get your solicitor to get it in writing that they don't want the car anymore and it is included in the sale. Get them also to send the log book. Then call up the local breakers and get at least £100 scrap for it - I got £160 for a Mondeo a few months ago.

Wait until night time (very late - like after midnight) put some gloves on and push it out onto the road and deny all knowledge of it.

Oh, and if it is on the road, it has to be insured, so could be a problem if it isn't insured (for the owner).
  • Or just wait until Monday and see if its still there.......

Yep. I can think of many reasons (such as van hire for moving) that would mean a car would be (literally) the last item to be removed from the property.

    This simply wouldn't work.

And why's that? Tresspassing is a civil matter and if you can prove a loss you can sue them

The DVLA will come and move it if its not taxed, or when the tax funds out.

Chances of the OP being prosecuted are slim to none.
The police have better things to worry about, plus they would have to prove it was the OP that moved it.

The minute risk would be well worth it against the alternative of having a heap of junk in your driveway that you can't move.

We could probably discuss this until the cows come home. My advice has been to attempt to protect the OP's position but this is just the internet, he can do whatever he feels best suits him.

Why is this conversation even going on? The car is legally parked by its owners on the driveway of the house they also own, where's the problem.

Ask the EA to ask the SELLER what's going on. It's probably just the solicitor responding at their usual speed!
