Stopped by Police - No Ticket, No Speed Camera, No Speed Gun?

Hi,

Looking for a bit of advice. Was stopped by police last night at around 2am just finished delivering goods. Didn't realise it was a 20mph limit and went throught at about 30. The police came behind me, stopped me, told me I was doing about 33 mph.Note the about. Now the weird bit was they didn't show me a speed gun or anything, didn't breathlyse me or give me a ticket. I have a 13 year old license and have had tickets before, however I do have 9 points on my license. This occured in Aberdeen.

Now they did take down my license number and license, but that was it. Now I'm not sure if this was a warning or anything. Should I be worried?

Thanks for any help.

It was almost certainly just a warning.

There's so much you haven't told us.

    Marked car?

    Housing scheme?

    Industrial Zone.

I'm guessing this was NOT a traffic car - or if it was they didn't have a recently calibrated speedo.

If you didn't get the "You are going to be asked questions about (give a brief description of all the suspected offences). You are not bound to answer but if you do your answers [will be noted] [will be tape recorded and may be noted] and may be used in evidence. Do you understand?" bit

or 'This will be reported to the Procurator Fiscal with a view to prosecution ....' bit

I reckon that you've had an informal caution/warning - 'Be careful don't do it again.' type of thing - very lucky.

Without the correct wording being used at the roadside, I can't see this developing into a formal Police Caution.

Although that shouldn't be a problem for you either.

    Count your lucky stars, mate.

Hi, sorry for being vague. to be honest I had just finished an 18 hour shift and was eager to go home, when then told me I was free to go I thought I had got off, but it was only when it was the morning when I began worrying incase they were going to summon me to court.

It was a housing estate, I had made a delivery to a take-away. It was an unlit road with road marking on the ground saying 20. The road was empty apart from me and well the police car.

No rights were read out or anything, name and address taken down. They didn't even contact the DVLA or check who the van belonged to etc.

There was no speed gun, it was a marked vehicle. They said i was doing about 30, but the limit was 20. I did tell the police myself though that I had 9 points and that it will cause distress to my family as losing another 3 points would make me lose my job.

You would know if you were going to be prosecuted - they would tell you.

They were probably looking for drink drivers. Anyone speeding at that time is worth stopping. They may well have checked the registration number before they stopped you.

Just take it as a narrow escape.

I agree. You would have been given a bit of paper of some description if you were getting a ticket for it.

18 hour shift eh? Not sure about the rules in Scotland but dosn't that breach the working time directive? AFAIK max working day is 16 hours.

I'm only pointing this out so you are aware of this. You may want to check it out to make sure you are not exceeding your permitted working hours.

This also could depend on the type of vehicle you are driving.

As for the speeding, I would'nt worry until something drops through your letter box which, as others have said, is unlikely.

You'd think somebody already driving on 9 points would be ultra careful! Especially after an 28hr shift!!

Sounds like you need a good ban to calm down on our roads

You should be OK unl;ess they specifically told you what is going to happen next E.g. " you will receive a letter from x through the post" or what not then you should worry.

Sounds to me they just used speeding as a ruse to stop you and probe around the vehicle if the were genuinely stopping for speeding they would not use the word "about" that is like shooting themselves in the foot, they will also know what the limit in the road us so they would be content with just 30mph (looks like they didn't know it was a 20mph zone so they wanted to bump up the alleged speed up a little to guarantee a stop).

You were in an industrial estate at night where I presume a lot of break ins happen so they wanted to speak to you see if you behave nervously, whether your ID matches the registered keeper etc.

No professional thieves (professional as in those that break into industrial sites) would ever dream of using their own vans on a burgularly job. All industrial estates record 24 hour CCTV footage. So just matching your ID with your car should give them sufficient confidence that you're not a crook.
