    The contract is just for the airtime, the phone comes free.

    The contract will still become payable for the minimum term whether you cancel or not

    We set out an agreement as we were going through the order that i would pay the first two bills for her birthday and then it was her responsibility to pay it.
    This was after we had worked out we couldn't get it in her name at that exact time as she didn't have an address

    Just because she now has an address doesn't mean she will now pass a credit check though.

    Even if she were to pass the check as Grumbler says they won't transfer the account with an outstanding amount so either way you will have to pay the £177

    Meg you are missing the points, the emotional part does not come into it, you have an agreement with the network, and ultimately YOU are responsible for that, any sub letting you do with that is between you and the 3rd party, even if you took your sister to court, I wouldn't hold much confidence in you being succesful, at the time she did not have an address, that is not your problem, and until she has an address there were other ways of her holding a mobile, and perhaps obtaining a permanent address should have been higher on her priority. The sympathy posts can be had on the relationships board but in the meantime pay the bill and prepare for a fallout with your sister if she is to loose you down. :o

    Not true. The phone is supplied on condition of entering into the chargeable service contract. To claim it is free would be a breach of Schedule 1 Regulation 20 of the Consumer Protection from Unfair Trading Regulations 2008.

    wow ok lets change my statement to "the phone is given free on condition you take out a contract"

    either way the OP owes for the contract not the phone because the phone is not itemised on charges

    For the OP it makes no difference. The fact is that they have to pay the full contract price for the 'airtime' and the price/cost of the phone is irrelevant.

    But now onwards is your opportunity to accept that the phone is never free, the airtime cost that folk are paying for the 'free phone' deals are never the same as a sim only, so it is obvious that the phone cost is included, only tesco mobile I notice show the breakdown of the cost of the handset and the airtime.

    The world and his mate knows full well that the phone is factored into the price of the contract ....the whole purpose if saying the phone is "free" to the OP is that it's far simpler than going into a long exhaustive explanation of phone marketing and pricing where the exact price and cost of the phone is hardly ever shown .

    Whilst we all as regulars to this section know the stuation theres no need to blind the OP with science ....so for the sake of explaining to the OP lets stick to the phone is free and they owe for the contract ;)

    Either unlimited or not, no "quite" about it.

    If not then it is easy to run up a large bill as many threads on here show.
