    Read post #8 - you do not "name" anyone - you send it to "The Company Secretary, Company Name" - as far as the court are concerned it is properly addressed (even if the company has decided not to have a secretary) as it has been sent to the company at their registered address - the defendant will be named as the Limited company name.

    Nobody, because YOU don't send anyone a CCJ - only the courts can implement a CCJ.
  • Little confused now then. I went to a legal drop in centre and was told i needed to find the owners names and change my judgement to against them not the garage. As they could easily shut the garage down and re open it under another name and i wouldn't be able to chase my money if i won the court case and they didn't pay. Where as if its in the owners name baliffs can go to them for the money directly.

    The "legal drop in centre" have basically told you a load of crap.

    If the garage operates as a Limited company then it is the company that you claim against - not the directors or shareholders as individuals.

    The only bit they did get right is that they could shut the company down and reopen in another name - they can do that and if they do you won't be able to get your money back.

    The owners are protected, that is the whole idea of a limited liability company - the only liability the owners have is up to the amount of share capital they invested in the company (probably £1).

    You can make as many judgements as you like. You can sentence people to death, if you like. But the only judgements which count are judgements made by a proper court.

    I think you mean changing your claim. You claim against whomever you contracted to do the job. If you contracted a limited company, then you are wasting your time suing the individuals who own the company
    You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'

    Sorry but I agree with gb.

    Sounds like the drop in clinic has been filled with idiots. The whole point of limited is to separate the shareholders, directors and company in to different legal entities. You are suing the company, not the directors. The directors could for example change but the company would still owe the money.
