Why on earth didnt you come here first???
You may find you receive a court claim from ukcps as a result of you not coming here first....
The reason was that we were going through a lot of stress, with illness and passing away of my mother-in-law in October, and we had a baby boy 3 weeks ago.0 -
yep, sorry to hear that , its never easy as they say
but all we can do is reiterate that if you had come here after the NTK or PCN we would have reduced the stress by helping you
its too late now so its either pay or hope they dont issue court proceeedings for debt recovery
mitigation was never a valid appeal - end of story (they never consider it)0 -
Congrats and commiserations (as appropriate). The Circle of Life in one post.
We know it's not easy, and can be stressful. We're not "having a go" (although it may seem like it) - it's just a general groan of "If only big_boss had come here BEFORE doing the POPLA appeal and this would all be away, and would have been much less stressful".0 -
Thanks. What happens if it goes to court?0

If you get court papers come back immediately.Proud to be a member of the Anti Enforcement Hobbyist Gang.:D:T0

it will now go to debt recovery and they will pursue you for months and months, long before any court proceedings are started, with plenty of pressure and legal threats
might take several months or more before the DR pass it back to the creditor for court proceedings , then its as above0 -
Or a Letter Before Action/Letter Before (County Court) Claim. One of these is kick-off of the court process, and needs to be actioned. Meanwhile ignore all debt collectors letters.kirkbyinfurnesslad wrote: »If you get court papers come back immediately.
One other thing. If the driver was someone other than the registered keeper, and if all the appeal steps so far have been done as the registered keeper, and if you have not at any point said who the driver was, then you could now go back to UKCPS, name the driver and start the whole process over again - and win this time. I think you may have alredy admitted who the driver was, though

Thanks for the replies. Personally, I want to take it all the way further, but my wife advises me to pay up. Can I ask UKCPS to explain how it arrived at the £100 charge?0

They won't tell you and won't care, so don't bother.
Right now it's a matter of sit tight and ignore anything (but keep in a file) unless it says Letter Before Action / Letter Before (County Court) Claim and/or are court papers (from Northampton County Court). At that point come back here for help.
Check out the LBCCC sticky thread at the top of the forum.
OR pay up - your choice. (I know what I would do).0
