Debt Recovery Plus Ltd-ignore or appeal?

Hi guys/gals-have a letter from 'Debt recovery Plus Ltd' threatening Court Action over a fine. Have read up as much as i can re: new regs but am still a bit confused as to either a)-IGNORE (I have done this in 20011/2012 & letter simply stopped) or appeal.

The client they work for is a member of BPA by the way. To cut a long story short we had an urgent appointment with my g/f/s psychiatrist (she was quite ill at the time-thankfully fine now) & were running late. Had no change-asked the only 2 people I saw if they had change & they had none-so did not get a ticket. Came back to see the 'ticket' (ie invoice!) on the windscreen.

I've worked for Stepchange (when it was CCCS before) so am aware of the County Court System & that this can't affect my credit rating (only if I don't pay a figure given by the court-in the unlikely event they took it this far). Looking at the figures (they claim £115) it wouldn't be worth their while to take it further. If it DID go to Court I'd be more than happy to attend.

So...based on anyones recent feedback-ignore or appeal? I do have good circumstances (provable) to state why a ticket was not bought.

Any thoughts?

    Aside from the fact that DR+ are extremely unlikely to have been assigned the debt in the first place and cannot therefore institute proceedings on their own account and private parking companies have a number of hoops through which they have to pass for their case to be capable of being pursued.

    Which company was it? When was the original ticket issued and did you receive from them a notice to keeper within 56 days of the original ticket? Have they stated that they are pursuing you as the keeper of the vehicle concerned?
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    clearly the answers depend on your region (which you never mentioned) but it changed 12 months ago for E+W so for E+W there is different advice than before

    the sticky threads have good info on this so its well worth studying them

    Hi! My that was fast! yes I'm sure they sent me a 'notice to keeper' within 56 days (binned it I'm afraid). Minster Baywatch is 'the creditor' (also 'their client' on the letter). I live in England. The title for the letter says 'demand for payment of an unpaid parking charge'.

    Why? We never advised actually binning letters even last year when the advice WAS 'ignore' which it is not now.

    Minster Baywatch are nasty and have tried small claims before now so start keeping the letters in a file. Read other DRP threads please just by searching the forum for 'Recovery' as a keyword. And do read the 'newbies' sticky thread which explains the 2013 advice as we were tearing our hair out that too many people were not sussing that things had changed this year, despite clear advice on page one for months, to APPEAL and learn how to win at POPLA. You've missed the chance to appeal in time but it's never too late to try (as KEEPER ONLY!) and never too late to complain.

    You'd do well to read the NEWBIES and the SUCCESSFUL COMPLAINTS sticky threads for starters as well as searching the sub-forum for 'Recovery' to see how common this junk mail is and that we don't need an update every time a letter arrives (which some posters were doing). Too many threads, not enough reading.

    Thanks Coupon Mad! Just clear it up I'm not at all implying that you/anyone on here advised to bin letter. At the time received my g/f was not well (she has bi-polar)but recovering & in retrospect-yes I should have kept it-but didn't want to add to her stress by her seeing it. I can see you've done loads of great work on here. I will pour a large g & t & hunt for threads & read the stickies. Again-thanks for your help.

    If you are prepared to do court, then why not just call them and tell them to get straight on with the threats and stop messing about.
    This is what I do.
    I also love a good court battle.

    And here's the next person posting today about DRP, so you can see why there's frustration on here when people haven't appealed but also haven't read the stickies yet!

    Ok guys. Point taken. Will just read other posts & not add to this one. MSE used to be such a friendly forum. Coupon-mad-you've done a lot of great work here-but your replies are, to be blunt-a tad un-friendly. This is a PUBLIC forum-not owned/run by YOU. During the past few months I have had slightly more pressing things-like helping my ill girlfriend towards recovery-than reading all the threads on here. Will leave this thread now.

    You have no idea the hours we spend here, only for people to start two or three threads a day about Debt Recovery Plus when you'd think they might search?

    And I know about more pressing, life issues - life really is too short. Other regulars here know that I suffered a close sudden bereavement in August but when I couldn't sleep I was here posting to help people within a week or two. Maybe that's why I was a bit short with you and for that I apologise.
