Okay before it's sent please post it here. Don't you want the registered keeper dealing with this? You can do everything on her behalf, it doesn't give them the driver details.

Yes am currently writing up an appeal on one of their appeal forms.

Well of course ONLY when the Notice to Keeper has arrived in the post, not before. And that won't be until January.

As you will have read in the sticky thread for newbies. Also read the 'successful complaints' sticky thread as it has examples of McDonalds Managers cancelling MET tickets, easy to do.

Your only urgent task is to chase up the McDonalds Manager to see if he has got it cancelled yet or if he even bothered with the email.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Hi All

this is a draft, is it ok?

    Notice Number:
    Date of Issue: 14/11/2013
    Vehicle Registration:

This letter is a formal challenge to the issue of your Parking Charge Notice - Notice to Keeper as set out in the current BPA Ltd AOS Code of Practice B.22

I am writing to challenge the aforementioned penalty charge notice, issued to the vehicle for allegedly “Code: 08 The vehicles driver was not on the premises at the time of survey”
I am disputing the aforementioned charge because I was on the premises from the time I had parked the car in the car park until I had finished my meal and left within the 90 min allowed for parking.

    1. I arrived at the McDonalds car park.
    2. Parked my car and went into the restaurant.
    3. Once in the restaurant I went to the toilets.
    4. I then made a call using my mobile phone whilst waiting for
my friend to arrive. My friend arrived a few minutes later.
    5. We then proceeded to order our meals in the queue
    6. We sat down awaiting our meals
    7. A parking attendant came to our table and asked if we had a
car in the car park. I told him I had a Vauxhall Astra
    registration
*****. for which he asked me to point out in which general
direction it was, which I did.
    8. Our meals arrived, we ate.
    9. My friend went to order some extras and noticed something
was on my car. A PCN/Notice to Driver NTD had been placed.
    10. I spoke to the manager who agreed that I had been
in the restaurant after checking CCTV and remembering when
I had arrived as he was outside talking to some customers at
    the time.
    11. We spoke to the parking attendants. I asked them why they had issue me with a ticket especially when they had spoken to me. They replied that unfortunately they had already issued me with NTD ticket. And that they must not have seen me whilst I was in the toilet or in the queue. They also made reference to their lack of training having only been in the job for 1-2 weeks.

I have never had an instance such as this. The manager of the restaurant has checked his CCTV he has also emailed yourselves. As stated I was on the premises from the time I had my meal. The parking attendants have not carried out an appropriate survey of the premises as the whole method in my opinion and McDonald’s manager is flawed. On this basis I if you refuse this challenge/appeal then please supply me with a POPLA code.

    Best regards,

You are admitting you are the driver, not a wise thing to do, and it's on mitigation and will be turned down

    Dear MET

I am as the registered keeper of ( reg) and am in receipt of your notice to keeper xxxxx dated xxxxxx, all liability to your company is denied, so wish to invoke your appeals process on the following:

    1) This charge is not a genuine pre-estimate of loss
    2) You do not have the authority or permission to give these invoices to motorists
    3) Your signage is inadequate, and does not comply with the BPA Code of Practice

You are therefore invited to cancel this charge now, or supply a popla verification code to appeal to them, where you will be asked for a detailed breakdown of the above. As you know all appeals on the above are upheld.

Please confirm cancellation within 35 days of the above date

    Faithfully
    The registered keeper

  • so i should not tell them exactly what happened?

should I just send a letter very similar to yours instead without detailing the events of what happened?

Personally I would go with Chiko48's appeal as it is the truth & is not mitigation but a complete denial that the 'offence' ever occurred. He has a receipt proving that he was a 'genuine' customer timed one minute before the parking ticket was issued & this fact should be added to the appeal.

I would really expect the manager to get this cancelled though.

What a bizarre method of parking enforcement. It would be interesting to read what is on the entrance signs.
  • We have only received the Notice to Driver NTD as it was stuck on the car. And still within the 28 days appeals process.
