Hi,

This is B2B transaction.

I have a IPHONE 4S through my limited company.

Have expensive insurance taken out with phone, via Vodaphone shop.

Out of Warranty.

Dropped phone, so claimed on insurance (about 5 weeks back). Did this via Vodaphone shop. Claim accepted.

Got reconditioned phone back 4 weeks back ago - wifi not working - on OS V6 - not OS 7. Went straight back into shop to try to sort - was informed that it was a software issue - need to upgrade to latest version - after 2 weeks of trying this, eventually managed it - still no wifi.

So went back in to shop last week, no joy - told to see Apple store. Apple stated hardware issue. So not interested.

Vodaphone not interested, because out of warranty - although they did say I could get out of contract by paying £300+!!!!

Insurance company not interested because not accidental damage!! Although never worked since got back.

So now have phone that does not work with wifi / bluetooth.

Any advice???

Mark

Why would they say that dropping the phone is not accidental damage? You need to challenge them on this.

Apologies - looks like my post is slightly misleading!! Will update.

Basically insurance sent me a re-conditioned phone, this is what is not working!!!

Who underwrites the insurance? When I claimed, the replacement unit came with some paperwork which said the replacement had a limited warranty - 60 days rings a bell on mine. Try the insurance company again- I can't see how they can get out of their responsibility to supply a working replacement?

or, 'accidentally' drop it again.... ;)

You need to tell the insurance company that you are rejecting the phone because it is defective.

Regardless of whether the supplied goods are brand new or second hand, you have a reasonable expectation that the goods will be at least as durable as the original goods.

You've received a faulty replacement handset, so it is up to your insurers to get one tag works as advertised. Unless you were promised a new for old replacement (rare) a refurb phone should pass stringent tests - more than a new handset - in order to be returned to stock.
