Security clearance denied. What can I do?

    My husband's DBS certificate has just arrived today, an enhanced one as he does cleaning in a local school.

    The first box says Police Records of Convictions, cautions, Reprimands and Warnings.

    The other boxes are:

    Information from the list held under Section 141 of the Education Act 2002.
    DBS Children's Barred List information
    DBS Adults' Barred List information
    Other relevant information disclosed at the Chief Police Officer(s) discretion.

    I'm wondering if the police who arrested you recorded that you'd been given a warning?

    I think you need to find out exactly why you've failed security clearance. If it is the arrest 20+ years ago then you need to ask would it have made a difference if you'd declared it. If it's something else then you can hopefully get the issue resolved.

    Another thing, have you ever lived in an HMO or a flat/bedsit in a building that's been converted into flats/bedsits?

    If an enhanced check it would show up - I know we were told if we didn't disclose something and it came out then game over - however if we disclosed then each situation would be taken individually but that non-disclosure would be taken as dishonesty

    If it was the arrest that got me the rejection. Is there any chance for me to appeal the rejection on the grounds of I didn't think the arrest was on my record and therefore didnt think I needed to disclose it?

    I'm guessing not...

    If I apply for a job that requires SC checks in the future, will I be able to apply again and would this rejection go against me next time.

    Mine has these headers, with something along the lines of 'no trace' recorded against everything except the last, where it clearly states there is info I was stopped by Essex Police in 2004 at about 98mph, and I was given a telling off. This was a check for a taxi badge (although from before I drove professionally), so is technically relevant information.

    If that remained on file, there's a good chance a caution will.

    Hopefully, this will be something that you can get sorted out before that.

    Ask what it was, and whatever it is, be honest.

    The description of events the Op gives would be consistent with them having accepted a Police Caution.

    phone the police, and ask if you have a caution on your file...

    they told me i didn't when i was concerned, and explained what being 'bound over; was for me when i was asked to sign to say i never had been...

    we too were told that of we were found to have misled on our DBS/CRB forms we would be thrown of our uni course, but if we put something down, then we would be considered, as long as they felt that at the end of the course we would be employable... (so if we'd been conviveted of shoplifting at 17 we probably would have been fine, but violence against a child would have been a big no, no)...

    when will they tell you why you were refused???

    A friend of mine said if it was a police caution then I would of received a letter of confirmation (of the caution I received). I definitely didn't have any letters about it?

    I'm not sure my contact at the council was informed 2 days ago. So should be soon. I just hope if it was this I can get the chance to explain my situation.

    They let you out with no charge after an hour and you had class a's? Is that normal?

    How on earth did they know his cousins family friends? Bit of a tenuous link surely. Maybe it was his cousin and he just didn't want to tell you ;)

    I imagine it depends on quantity - a person with one tablet, or a tiny bit of coke may not be worth the paper work, or costs involved for more than a caution if a first offense maybe???

    For a security clearance at CTC or SC level, the form specifically asks you if you have been arrested before. As you presumably denied this and were found to be lying, your clearance was probably rejected on the grounds of dishonesty at least.

    When I completed my form, I remember that it also included questions about mental and physical health problems. I had to declare them as they would be discovered, despite my never having been arrested.

    For security clearance, they don't just use enhanced disclosure, but Police intelligence and other information.

    Edited to add: It is foolish to assume that you can deny something on a security clearance because you think it might have been 'spent'.
