There was a program today, today being yesterday that is, with a guy who had issues with his wedding video, and ultimately wanted the money back. Don't know the details, or. How, but the program followed the work of the sherriffs in getting the cash back.

My brain isn't working, and on an iPad failing to type properly ATM, but it was either Thursday, or Wednesdays episode, bbc 1 11am-ish. Not sure of the limits with small claims, but this should be something you should be able to persue money back regarding broken contracts, and unsatisfactory work, without needing to pay for a solicitor. One thing to remember, it's terribly emotional for you all involved, but for a judge to look at and decide on, it needs to be cold hard facts on any form.

Ask on the consumer rights board, if you haven't already for advice to go from here. I would guess it wold be a letter before action of either work completed properly and a reissue of an un branded album of suitable quality, or if you just want to take a refund and deal elsewhere with picture editing.

To me the photographers package description is very sloppily worded and they have left themselves open to a dispute. Use of the word 'all' is misleading - maybe not in the trade, but it is to the general public.

One word of warning though. One of my employees had a dispute with their photographer, it got nasty and ended up in court. In the end the photographer refunded them all money, less a small amount for something-or-other - but it means they do not have any professional photographs or video from their wedding. They were happy with the video and offered to pay for that, but the photographer refused to "split" the package.

  • So 'editing' no longer means editing?

News to me, and I've only being 'editing' 20 years.....

If the startup hasn't got her literature correct that's on her, as is all the framing and composition of pictures.

Get her to court, we need cowboys like this out if the industry ASAP.

But like someone posted above what happens if you take them to court and the judge agrees that the photographer is in the wrong and the customers does not have to pay for the goods. As someone pointed out above does the customer still get to keep the goods? or does the photographer get them meaning the couple are left with no wedding photos.

would depend on what your asking the judge to decide.

partial refund for lack of service and quality plus untimely completion of the service.

    or a full refund.

DIL bought the disk and copyright of the photos - that isn't a problem we can have a new album made up! I just wanted to know what you all thought.

I wouldn't think they would ask for a full refund - she turned up she did her job - we aren't much impressed with most of the pictures - but that is subjective. its the fact the 'Album' - the end result is so cheap and shoddy and its taken so long to actually get it from her!
  • How much reasonably do you want back? 10%, 25%?

houseimprover - if she refuses to put things right, then I would think the cost of having another, decent, album made up by a proper professional photographer. but, I haven't spoken to DIL today and its up to her to decide what to do.

the reason I am not confident she will put things right, is that I have been doing some research on this woman. I have found that this is the second photography business she has started in the last few years, one in her married name and this one in her maiden name.
Three years ago she filed for bankruptcy from another business - and her creditors are still waiting to be repaid.

I wish I had done that when my DIL said she was hiring her - I assumed at the time she was a real professional. (Her family are all in the photography business)
