I sent my PPI claim to the Bank first which got rejected, then I sent the details to FOS. FOS said go to the retailer, the retailer replied stating the loan was via the bank and also the bank was responsible for the PPI.
I am still confused and perhaps this is why the FOS were. If you bought a black horse loan then you would expect black horse or the broker to have the liability for the complaint. Your bank doesnt come into it. So, why would you complain to the bank about black horse?I am an Independent Financial Adviser (IFA). Did you receive a "full and final" response about your original complaint? If you did, it's very surprising that the bank allowed you to complain a second time.
There seems to be quite a lot of information you are still withholding (despite posting about it in two threads) and we won't get to the bottom of it until you answer the questions myself and others have been asking;
Who is the retailer?
Did FOS advise you to complain to the seller of the PPI or the actual retailer?
Did you receive a "full and final" response to your original complaint, or did Black Horse write back seeking more information?0 -
The retailer was a motorhome dealer in the Midlands
The FOS advised to complain to the retailer
I received a full response from the Black Horse with my original complaint
The loan was with the Black Horse the PPI was part of the loan agreement with the Black Horse (This was confirmed by the retailer)
My PPI payout was made out to me by the Black Horse, the original response from the Black Horse was basically all the reasons allegedly why I needed PPI
PS The bank never allowed me to complain a second time they allowed a PPI Claims company to do it !!!!! and I am surprised at the comments it is a known fact people have been given the wrong information regarding PPI first time round0 -
In a nutshell Black Horse have eventually paid out, if they had paid out on my first request I would not have had to pay a PPI company £1000. I will be contacting the Black Horse watch this space.0

It sounds like the motorhome dealer was the seller and ought to have been complained to, as FOS said.
You got an ambulance chaser to take it on and they, with usual incompetence, sent it to the lender, rather than the seller.
At that point they (and you) got lucky as this time around the lender was incompetent too and failed to notice that it did not sell the insurance and had already responded to your complaint.
So it paid out.
You therefore received money you were not entitled to.
I presume you never followed the advice of FOS and complained to the actual seller.0 -
The motorhome dealer sold you the PPI and the loan, Black horse provided the credit.
Unless they were acting as agents of BH, BH had no liability. As above, they probably didn'r investigate properly otherwise they could have rejected for no liability [ if they weren't liable]
You didn't have to approach a PPI company, you chose to. The fact the BH upheld your complaint [ or was it a goodwill?] in no way makes them liable to pay for your choice to employ the firm, nor does it make them liable because they upheld this time round and not 2 years ago.Non me fac calcitrare tuum culi0 -
