Hi
hoping for a bit of help here if possible. This may get long so please bear with me.
A few months ago we sold a reconditioned cylinder head, the customer got intouch to say the head was faulty as the car was smoking. we told the customer to return the head and we would check it, on recieving the head we found no fault with it at all so returned it to the garage fixing the car at the customers request, the garage refused delivery and the head was returned to us. We then refunded the customers money.
fast forward 3 months and we receive a letter from the customer demanding £2800 for repairs to the car, the customer is claiming for labour and parts, he says the head had to be taken off the car twice and new parts were needed each time (some of the new parts were replaced unnecessarly the second time)
Where do we stand with this as we found no fault with the part we sold?????
The cylinder head in question has been sold since the garage refused the delivery to a very happy customer so there was definatley no fault with the head!!!!
He sent thi letter by recorded delivery and it is from himself and not a solicitor or anything
Thank you for any help you can give me on this matter

Start getting your ducks in a row ie gather all correspondence and evidence you have.
Not sure if I would reply but if you feel the need to then I would talk to a solicitor first.0 -
Thanks for the reply, unfortunately all correspondance was done over the phone, this is the first thing we have in writing0

Who were you dealing with, the garage or the customer directly ?Be happy...;)0

Do you still have this head, for I would have thought that the customers owes for the Cylinder head they ordered if they are going to become litigant over the issue plus the time and cost of messing about for them .
If you have this head they ordered and a copy of the order I would bill them in return for the cylinder head and ask where they want it delivering to.
Two can play daft beggars.Be happy...;)0 -
Hi
it was the customer we were dealing with at first, the garage only got in touch to ask if we had found fault with the head, we told them there was no fault, that is the only contact we have had wth the garage.
The customer then got in touch for a refund which we did straight away.
we have had no further contact with him until now
Thank you0 -

no we dont still have the head as it has been sold to a very happy customer0 -
The car was taken to the garage faulty, you supplied a part, they returned the part, you refunded having found no fault.
You have no liability to pay for repairs to his car, I would Ignore him until he sends a compliant Letter before claim.
Then let him waste his money in court.Be happy...;)0 -
Was the part new or secondhand/used? Are you a registered company or a private individual?0
