Bonkers:rotfl::rotfl::rotfl::rotfl::rotfl:We have received the following reply, it would seem we have finally gotten somewhere.
Thank you all again for your help with this.
Without Prejudice
I have spoken with Haart Estate Agents today and have informed them that you will drop off the keys to the flat on 31 December 2014 to their offices in Hamlet Court Road.
I have been advised to take the meter readings, with photographic evidence and would ask that you inform my agents of your energy supplier/s enabling calculations & finalising your accounts.
As my earlier request, you leave the property in a clean and tidy condition including the picture rails, mould & sellotape from the windows, shut off/down the water just in case of any leaks or burst pipes.
Haart have confirmed that reasonable notice for viewings are 24 hours, and they shall give you as much notice as possible via, email, phone or text. I would request that you inform Haart of any dates you are not available from now until 31 December so they can schedule any future viewings around?
Thank you for your help and cooperation in this matter.
I suggest that you send a written copy of the e-mail you sent the LL previously to the LL and copy in Haart.
There is a chance that someone at Haart knows the meaning of "quiet enjoyment" and understand the basic regarding utilities! Although since EAs require no legal training, that might be a hope to far.
It is reasonable to let the EA know who the energy supplier are so that they can inform the new tenants.
Take your own photos of the meter reading and inform the utilities, giving them a forwarding address for the final bill. The EA do not need that to finalise the accounts.
I suggest that if Haart are daft enough to contact you re viewing you simply remind them that you are entitled to quiet enjoyment and will not be available.
When do you expect to move to the new house? If you've have not made a mistake, you've made nothing0 -
Having read the entire thread, I'm confused.
Is this tenancy now ending on 31 December? I though OP had given amonths notice to end the tenancy on 26th Dec (with Tenancy Periods running 27th to 26th each month)?
Keeping the keys beyond 26th muddies the legal waters....0 -

Handing them in on the 26th could be tricky, though. Do estate agents open on bank holidays?0 -

The OP has not answered the questions about the start and end date of the fixed term.
However the rental payment period in the original contract was 27-26 monthly.
The LL thinks that because the rent is currrently paid 1-end or the month then the tenancy will cease on December 31. There has been no new writtne contract.
It appears that the LL has got the message that the tenant only gives one month's notice but the OP really does need to be absolutely sure about the end date.
Personally I would get out on Decenber 24 and get the keys returned then.If you've have not made a mistake, you've made nothing0 -
Most agents have a letter box.Handing them in on the 26th could be tricky, though. Do estate agents open on bank holidays?
Most tenants these days seem to have cameras in their phones.
A cheap newspaper costs 10p and can be included in the photo of the keys being put through the letter box to prove the date.0 -
Except that you cannot actually prove a specific date that way. You can only prove the earliest possible date with a newspaper, ie. you can take a photo of the paper's issue of 26th but the only thing this proves is that the photo was not taken any earlier than the 26th. You could equally keep the paper and photograph it on the 31st, or any other later date.A cheap newspaper costs 10p and can be included in the photo of the keys being put through the letter box to prove the date.
This may sound pedantic, but in light of the LL attitude I would surrender the keys in a more undisputable manner. You wanna hear about my new obsession?
I'm riding high upon a deep recession...0 -
Sounds like the letting agents (or maybe a solicitor) has put this barmy landlord straight about a few things!
I would be a bit worried about the discrepancy on the dates though, could it be they are trying to trick you into going into a new rental period, so that you end up being liable for the January rent after all? Or could it be as simple as that the agency is closed between Xmas and New Year?
And did you notice it actually says 31st December 2014, not 2013? You would assume it is a typo but .....
I would clarify all this with the LAs. You don't want to get caught out.0 -

Indeed - and a photo of an envelope going through a letterbox with a newspaper also in shot doesn't prove that the envelope actually carried on through the letterbox and wasn't pulled back out again, nor that it contained keys.
Far safer to hand the keys to a real person and get a receipt.0
