it was a short wheel base transit van not to sure of the weight, but defo there was a central reservation0
-
OK then it's not a car derived van and it's over 2tonnes gross.
Exactly which roundabout was this?
The A35 has quite a bit of central reservations that are just cross-hatching painted on the road - but that does not constitute a dual carriageway that needs a physical barrier.0 -
no idea what roundabout.
and sooler no drive awareness option0 -
Was it between Bridport and Dorchester?
There is no significant amount of genuine dual carriageway there. But it might look like dual carriageway owing to the grass in the middle between the two carriageways.
I know a section of road similar in NE Scotland which is a cash cow for the speed camera vans as almost everyone thinks it's a real dual carriageway.
You need to get the exact location of the camera van and/or a photo of the road before deciding to fight this one.
I have a Sprinter van and I learnt the hard way years ago to look out for such 'ambiguous' sections of road.0 -
also just noticed that even though they have got the correct post code but they have wrote the street I live on wrong. clutching at straws I know but is it sugnificant0
-
iceweasel, im 99% its got a central reservation on that section not just a grassed area it has physical barriers. I will have a look on google maps tomorrow and do the journey that way as I will know when I see it the point the van was parked.0

I would not hold out much hope for the wrong street address mistake being of any help.
They could easily issue further charges with the address corrected.
Even if it went to court that old chestnut of 'de minimis non curat lex' would no doubt apply - The law does not concern itself with trifles.
Have a good look on google maps and come back tomorrow with the location.
Good luck mate.0 -
will do thanks for your input so far everyone much appreciated0

If they can prove you are over the actual limit, they go for it.
However, the CPS do, so if it was a dual carriageway, ask to go to court.
If you do go to court and the speed that you are charged with doing is 61 in a 60 limit, I would think that you would have an extremely good chance of getting the case dismissed simply by quoting the ACPO statement about the accuracy of the equipment used by the police.
It might also be worth quoting this when you respond to the NIP.
Their equipment may be 2mph which is a figure in excess of the amount that you were over the limit (Providing that the limit was 60mph)
