Parking Charge by UKCPS Ltd

Please Help! Received parking charge of £100 reduced to £60 of paid within 14 days. I have already appealed and received reply denying my appeal. Thinking of just asking them for POPLA Verefification Code. I was parked in Disabled Bay outside B & Q on large retail park. I was taking my 86 yr old dad and 84 yr old mum to B & Q. They spent £230. I parked in bay because I needed the extra space near the entrance to get wheelchair out of car. I do not have a Blue Badge sticker, mum & dad cannot drive. Any advice as to what to write next. I have 7 days they say. I also wrote to B & Q store manager and got no reply. B & Q are just tenants and don't own the Retail Park.

    You should have received a verification code & details of how to submit your appeal to POPLA when the PPC refused your appeal to them. Some PPCs are very reluctant to give out a POPLA code despite the fact they are obliged to do so this is because they routinely lose & it costs them money.

    The fact that you do not have a blue badge does not absolve the parking company nor B&Q of their Equality Act 2010 responsibilities to make "reasonable adjustments". This might include allowing your parents extra time, level access or more space to get in or out of a vehicle.

    I suggest that you write immediately to the parking company and demand that they supply you with a POPLA code - as they are obliged to do under the terms of the British Parking Association Approved Operator Scheme Code of Practice - assuming that they are actually members.

    Once you have it come back here for guidance on how to draft your POPLA appeal. I'm sure Coupon-Mad (resident expert on the Equality Act) will be along shortly to advise you on how to go after both the parking company and B&Q.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    OP - you need to read this Pepipoo thread by Grunwald - it's very relevant. A case involving a non BB display at B&Q. Excel was the PPC involved (which PPC are you dealing with?).

    Complain to the CEO of B&Q or head office.

    And yes, write and say you require a POPLA code now because to pursue this is against the Equality Act as UKCPS well know, and their charge is not a genuine pre-estimate of loss.

    Then get our help to write you a winning POPLA appeal.

    Washalowski - you should also consider getting your parents each to apply to their local council for a blue badge. Blue Badges are assigned to the person and not a vehicle and then anybody who drives your parents around at any time can use the badge when they either are present or collecting them.

    Hopefully B&Q will get this charge cancelled for you but you will win at POPLA if not.
  • I posted a couple of weeks ago. Appeal denied by UKCPS. POPLA code received. What do I write? In brief, I parked in disabled bay o/s B & Q because I needed the space near entrance. I was taking my 87 yr old dad and his wheelchair and my 83 yr old mum, to B & Q. Car park was quite empty. They spent £230 in B & Q. Have Emailed to CEO of B & Q as advised and no reply. Your previous advise mentions the equality Act. Thanks!
