  • I just rang the college to ask who I direct the letter to, it goes to estates, I didn't give details over the phone as to who was driving and just asked who would deal with a complaint. Got a name and was asked why I was complaining, I said they are not allowed to use the word Penalty on the sign, they wasn't aware of this and said they had been checked over the summer. So on with the letter and post it 1st class for delivery tomorrow. Hopefully the college will ring/write back saying they have cancelled it. Do I give my details or my sons? usual date, address, telephone number and all the numbers off the ticket? Thank you

    Give them your details as the registered keeper (is my understanding).

  • If you can, go to the post office to send the letter and get a (free) certificate of posting.

    You still haven't said who the registered keeper of the car is. Give any details, but don't say that you/he were the driver. Just write as the keeper of the vehicle.

    Your son being only 17 is interesting. If they pursue the driver, they are trying to enforce a contract on someone not old enough to enter into such.
  • I wouldn't give your son's address as I presume you are writing from your own (different) address and we don't want to hand to Ethical both addresses! You will need to give the date and time on the parking charge notice and the reference number though.

    Keep copies of everything safe.

    Also write in the format of "the driver received" - i.e. be non committal if it was you or your son when complaining to the college.

    Also follow the other steps as given in Hovites post NO: 9

    Contact details for who to complain to at the BPA are given in the link I supplied in my first post.

    Also as Hovite asked re post 7 - did this happen in England or Wales?

    Yes do you think (un)Ethical will attempt to pursue RK? Will be interesting when RK names son as driver..........:)

    EDIT: Of course it will not get that far anyway - cancelled either by principal landowner or POPLA. However son's age should make an interesting additional appeal point to POPLA.

I double checked with BPA and PENALTY cannot be used. BPA do say to appeal straight away, but I will wait a bit to see if the college actually gets it cancelled.

    Don't forget to point out the threat of a criminal act ! After all, would they dare to put up that those who do not comply with the T&Cs will have their tyres slashed ?

    When you do get the NtK ( assuming it actually goes that far now ) bounce this thread and do not contact Ethical directly until you have done so.

    Do not write as registered keeper when complaining to college as NtK has not yet arrived. Hence per my earlier post write in third party t"he driver" - without identifying if it was yourself or your son.
