Parking Ticket

Hi I have been reading up but still not sure what to do.
My son came home from college with a parking ticket issued on his windscreen, saying he had not displayed a valid parking permit. he has a permit, but it says student 2012-2013, he thought it was valid, I'm thinking he should have got a new one when he started back in September, he has been using this since then. He also has to pay 50p per day to park on the college site, yesterday he didn't have 50p so put in a £1. The ticket says if he pays within 14 days the £80 will be discounted to £40. He is a student, does not have much money, works in his spare time to keep his car on the road all legal. Couldn't they have just put a letter saying we will be back tomorrow if it the same you get a ticket?
I want to ignore this but know thats probably not the best move. Are they allowed to do this?

    PS - your son should get another permit as the year probably applies to the academic season which ended summer 2013.
  • Hi he went into college today and asked if the permit he has is valid, they say no it was last years academic year and have today issued him with a valid one. The college advises him to pay the reduced £40 within the 14 days, and say there is nothing the college can do about this. I got him to take pictures of the signs and they both say a valid permit and ticket must be shown or face a fine of £80
  • Tell him not to pay and wait for advice on here.

    Annoyed mom -Did you read my earlier posts?

    Please read the thread given in post 2 and supply the name of the parking company.

    Did the signs really say FINE as a parking company cannot issue a fine as they have no statuatory powers to do so.

    This charge can be successfully appealed if you follow forum advice.
    The college advises him to pay the reduced £40 within the 14 days, and say there is nothing the college can do about this.

    Your son's college is trying it on probably due to the fact they receive a percentage of parking charges collected - all part of the massive parking company scamming business.:)

    The college advice is WRONG !!!!

    Also, do the signs really say the word "fine" ?

    OK, some questions :

    1. Who is the registered keeper of the car ?
    2. Did this take place in England or Wales ?
    3. Who issued the ticket - i.e. who does it say to pay ?
  • Thanks for the info, I did wonder if the college gets a percentage.
    Its from Ethical Parking Management who is a member of the BPA. The ticket says its a Contractual Breach Charge, also says that details will be requested from DVLA and if not paid passed onto a debt recovery specialist with an additional £60 added. My son is 17 and does not have the money to be taken to court, neither do I.
    There are two notices 1st says
    College parking regulations, monday to friday 8.00am - 4.00pm, Term time only. you must display permit and parking ticket, PENALTY CHARGE £80 ( reduced to £40 if paid in 14 days) for failure to display a valid permit and proof of payment. 50p per day (or any part thereof). Persistant offenders may be clamped.
    There is also a Warning sign which reads
    WARNING Parking Notice
    By entering you agree not to breach the following conditions:
    1. Parked without clearly displaying the required Car park permit and proof of payment.
    2. Not parked wholly within a designated parking bay
    Failure to comply with any of these conditions you agree to pay the parking charge of £80
    So not saying fine.

    You need to do three things for now :

    1. Wait for the Notice to Keeper ( do not contact Ethical yet )
    2. Complain to the college that they nor Ethical are not allowed to issue PENALTY charges and that if they don't cancel it immediately you will be reporting them and Ethical to the BPA.
    3. Report the signs to the BPA - they can't use the word PENALTY

    DO NOT indicate who was driving - any conversation you have with the college or the BPA you should refer to "the driver" and not imply if it was or wasn't you.

    EDIT - also point out to the college that they will be committing a crime if they allow their agent to clamp cars !

    Don't ask - demand ! Yes, you should but don't tell them who was driving.
