I have just had the decision sent to me by email from CISAS stating that WE WIN!!!
In short it says:
1. The claim succeeds in part.
2. I direct that the company should: provide the customer with an apology; provide the customer with his PAC; cancel the customer’s contract without penalty, backdating such cancellation to ***** 2014, thereby waiving any charges incurred after this date and; pay the customer compensation in the sum of £100.00
RandomCurve would you like the whole of the letter copy and pasted on here for the benefit and help of others?.............

I am still waiting on a response from EE, after they were given an extension with today being the deadline. Would love to see what would happen if EE AGAIN fail to provide a response!0 -
On my phone so have to brief. Congratulations on the wins if you can state which network and contract version you are that would useful. If you do post the result you need to remove personal information AND the adjudicators name.

Hi guys,
I am awaiting TMob/EE's defence via CISAS - June 13th is the deadline. Would my response to their defence (assuming its the usual one) be the one which has been used for changes to terms and conditions? Or is there one specific to the price rise?
Also, in my application to CISAS i followed the templates RC kindly shared with us and added a calculation of how the price increase is more than 2.7%. I realised after that the rise wouldn't show until this month's bill but I used the ''discount'' Tmob has been adding to my account when they thought delaying the increase would soften the blow. Was this the correct way of working it out?I have enough money to last me the rest of my life... unless I buy something.0 -

RC, are EE bound legally to follow the CISAS ruling or can they appeal it to a higher authority?0 -

The deadline for EE to submit their response was yesterday (4th June) and I've heard nothing from CISAS as of yet.
Should I
a) Try to push CISAS to appoint an adjudicator now since EE seem to have exceeded their allotted time?
or
b) Wait until the 11th or 12th and if I haven't heard back, chase CISAS?
In the letter I have from CISAS, there is no mention that EE could ask for an extension and therefore I don't know if CISAS would let me know if they did...0 -

I'm in exactly the same position as you, with a response from EE due on 4 June. Given the posts above showing capitulation from EE, is there a chance they'll not contest the CISAS cases further?0 -
I imagine that EE/T-mob/Orange will continue to contest CISAS cases. It's the small claims court where I'd expect them to back down as they'd stand to lose even more money I'd have thought. Plus if they don't contest, then they'd have a full on flood of customers trying to leave.
Anyone who is awaiting the reply from EE via CISAS - wait because the delay further shows the lack of care that EE are giving to the customers.
Delboy, well pleased to hear of your success - gives the rest of us some hope for our own cases. And even if my case ends up unsuccessful, it's nice that EE are at least losing some money on one person!0 -
Response received and seems to follow the usual pattern, once again they are trying to be cheeky by moving paragraphs around.. However,I noticed this:
"29. The application of the material detriment test to the change of terms is doubly complex. It is not sufficient simply that it is theoretically possible that the change could be of some detriment to the Claimant, as in the Claimant’s case that he is no longer a student. Rather it is necessary that the Claimant establish that that increase is of material detriment."
I was never a student when I entered into the contract with EE, presumably I just point this out as further lack of duty of care?0 -
Got my CISAS letter today - usual stuff in it, decision 3 weeks etc. Been appointed Ms Alison Dablin , anyone else been appointed her?
