WEE T-Mobile had until today to reply to CICAS with there evidence, not arrived but i guess CICAS will allow them an extension.
Can i ask CICAS to refuse this extension as one of my points is there non existent Customer Service and never getting back to you on time.
Regards
They probably have replied last minute. You should get something of cisas tomorrow, if not ring and tell them0 -
I have already emailed CICAS asking why they have not submitted evidence, guess i will have to wait lol0

quick question for rc!
have received the following back from cisas, no surprises really,
Further to our previous correspondence in regards to the above case, please see below the adjudicator’s response:
‘I am satisfied that the company are complying with my decision.’
We trust the above clarifies matters. I have copied the claimant into this email.
so now my next step is to take it to the scc route i am going to send EE letter before action, the question i have is do i need to keep the account open with EE whilst this goes on, and if as i suspect this goes over the 30 day time limit for the pac code will i then leave myself open to yet more dirty tactics from EE? do you have any ideas or comments on anything i need to specifically mention in my letter, i am going to use the stock letter off the C.A.B. website but alter it for my specific case?
many thanks0 -

You should use the PAC - you can still pursue via SCC .0 -
Anyone in the same position as me. I rejected the decision after i was unsuccessful with it what can I do next?0

my result from the adjudicator said the following
Therefore, my decision is that the customer’s claim succeeds in part. The company shall terminate the customer’s contract without penalty (this being backdated to 23 April 2014) and provide the customer with a PAC and compensation in the amount of £25.00.
is it me or am i reading something different to what EE seem to be seeing? i specifically asked for clarification from cisas regarding backdated charges i.e calls etc and was told i couldn't have these back (not that i use the phone that much anyway) however nothing was mentioned about line rental, however how can i be charged line rental when the adjudicator said to terminate the contract from the 23rd ? EE are not making this easy!!!!:mad::mad:
I find it strange 2 decisions worded the same, apart from no compo for me, can mean 2 different things. Below is a copy of mine and I received a refund for my June bill and my July bill waived. My adjudicator was CS
Decision
1. The claim succeeds in part.
2. The company shall terminate the customer’s contract without penalty (this being backdated to 3
June 2014) and provide the customer with a PAC code.
not sure it'll help but maybe write to CISAS pointing this out.

After 11 days and 2 emails I finally got, what looks like it will be, my last response from CISAS.
Dear,

Please accept our apologies for the delay in responding to you. As per Rule 5 (d) only the adjudicator can determine whether or not they are satisfied that the company has complied with their decision.

As the adjudicator has confirmed that he is satisfied with EE’s compliance, our file on this matter is closed and we are unable to enter into further discussions regarding the outcome of the decision.

Kind regards

SCC here we come. Something I did notice though, so far EE have taken 3 months payment since the date I should have been backdated from, the 4th being due next week, however the last payment was taken the day after my number was transferred to my new network!
How can they legally justify this?? My direct debit is now cancelled, as I've had nothing confirming my account is cancelled, and I highly expect EE would happen to "forget" to close my account and continue billing me, there's no way this thieving company is ever getting a penny from me again.0 -

seems very strange indeed!! cisas aren't playing ball anymore they obviously don't want to bite the proverbial hand by the looks of it!! i am going down the scc route now, would you have any objections if i use details from this post in my claim?

@Random Curve
I'm really late to the party and have submitted my claim relatively late (following my loss of the original T&C's CISAS claim) but still within the limits. CISAS have also been slow.
Anyway, CISAS have just sent me EE's defence. I'm on pre-October 2012 Orange contract. What is the most relevant defence template (from your fightmobileincreases.com website) - would it be the EE Defence Response from 26-6-14 template, or does it only apply to T-Mobile?
Also I would like to ask for advice on how to respond to EE's copy/paste response (below), and how much emphasis to put on it. As you may remember I rejected EE's T&C change but then eventually lost my CISAS claim.16. Save that the Respondent denies that the change in terms effective 26 March 2014 gave the Claimant the right to terminate his Agreement without charge the Respondent submits that in any event the Claimant was required to give notice to terminate prior to the change of terms taking effect on 26 March 2014. The Respondent submits that the Claimant failed to give notice to terminate the Agreement prior to 26 March 2014 and therefore is bound by the terms of the Agreement effective 26 March 2014.
Well, obviously I did give them notice, and they rejected it."Retail is for suckers"
