  • Ok, sorry I keep calling it a fine, it's just easier to refer to it that way I guess. So you're basically saying ignore this letter and don't send anything else to APCOA even to confirm they received my first letter?

    I never said that at all, I believe I was quite specific in what comes next, ie:- get the big boys in to kick some butt as you have done your side and they havent done theirs

    I certainly didnt tell you to ignore that letter

    the point about words is that you need to use the correct ones and be smarter than these c*wboys , and a fine is a legal term and is imposed by a court or a judge, not a private parking company

    I believe if you check every piece of paper they sent you, you wont find that word anywhere on it

    if it says anything at all, its parking charge notice, or pcn, so you call it that , or better still , call it an invoice , its only 3 more letters , and that is what it actually is, an invoice !

    so my advice is just do as I said in my previous post in paragraph 1, and wait
  • Apologies, I misread your previous post thinking you were referring to the letter I had already sent rather then send a new letter to the DVLA and BPA.

    if they are stupid enough (and they are) to ignore your appeal sent in correctly and I assume with proof of posting etc, and get the debt collectors in, your robust reply is to complain to the bpa and the dvla and get them involved due to apcoa breaking the COP that they are a party to, denying you your right to an appeal and a popla code (or cancellation)

    so they get the debt collectors in, you get the bpa and dvla in , one kicks the other (after you have submitted your paperwork to the bpa and dvla) and its either cancelled or a popla code comes back

    seems pretty clear cut to me , especially as the bpa and dvla have more sway then you do, and also because its what coupon mad clearly explains in post #6 of the newbies thread

  • Thank you for your reply and help. My initial letter wasn't sent by recorded delivery though so unfortunately I don't have proof of postage which is my only concern which is why I wasn't sure if I should send a copy of it again to APCOA

    they dont normally accept recorded delivery so I didnt expect that it went by recorded delivery

    that is why I said proof of postage, not recorded delivery

    proof of postage is free at the post office when you send a letter and is nothing to do with recorded delivery

    like I said earlier, its all about words, and the meaning of words

    if you wish to send in another copy of the appeal , stating its a copy and stating that they must have "lost" your original appeal so here it is again, and saying "by the way , I have reported you to the bpa and the dvla for ignoring my previous appeal and passing it on to the debt collectors , so call them off , NOW" then feel free to do so , but get free proof of posting from the post office when sending it

    but I would report them asap to the bpa and dvla, as you shouldnt have to be doing all this chasing around and they deserve a good kicking for treating people this way, the bpa even reminded them about their responsibilities recently, so there is no excuse in my book

    So APCOA still haven't responded to me and today we received another letter from their Debt Collection agency threatening us with court unless we pay within 12 days. I've written to the BPA and DVLA but not sure how I can escalate this. Should I write another letter to APCOA or is it not even worth doing this?

    I'm wondering if it's worth following the advice here and emailing the debt collectors

    did the bpa and dvla acknowledge your complaints ?

    if they did then they should be dealing with it , in any case you can ignore debt collector letters as it clearly tells you to do in the NEWBIES sticky thread

    debt collectors cannot take you to court, only the landowner or their legally appointed representatives , in which case they have to refer it back to the creditor

    if necessary, ask the bpa and dvla if there is any progress as you are being harassed by the DC employed by apcoa and its causing distress

    They do this all the time and should be reported to the DVLA and BPA every single time! Did you use the email addies for the BPA and DVLA which are in the thread I linked for you earlier on? Steve Clark and David Dunford, specifically (not just a 'contact us' email).
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
